will be exceptions made for owner occupied rentals, PUD' s and <br /> MPR' s where short term rentals are expressly noted in the <br /> associated development agreement and regulations applicability <br /> may be subject to Interlocal Agreements . He stated the applicant <br /> would be turning in a site plan which would include the ingress <br /> and egress information. A short term rental management plan <br /> would be completed, indicating fire suppression tools near burn <br /> areas, and the requirement of the decimal reader. Discussion <br /> occurred regarding the decimal readers, reporting, and <br /> violations . <br /> Motion by COMMISSIONER HINKLE that we abandon this issue <br /> completely and recommend to the County Commissioners to not do <br /> short term rental regulations . There was no second. CHAIR TAYLOR <br /> stated the motion is out of order. Motion died. <br /> LONG RANGE PLANNER JOHNSTON stated that this presentation is <br /> just an introduction and will be brought back to the Planning <br /> Commission as a formal process for a recommendation to the Board <br /> of County Commissioners . <br /> LONG RANGE PLANNER JOHNSTON introduced the SEPA appeal amendment <br /> topic. Currently there are SEPA appeals associated with <br /> Administrative Determinations . The way it was supposed to be <br /> structured is that those appeals go to the Hearing Examiner. <br /> With the way our code was structured there was some ambiguity <br /> about when they go to the Hearing Examiner or to the Growth <br /> Management Hearing Board or Superior Court . The point of this <br /> update is to clarify what was already intended, which is that <br /> all administrative decision go to the Hearing Examiner and all <br /> non-administrative decisions go to the Growth Management Hearing <br /> Board or Superior Court . The proposed changes would amend three <br /> code sections that deal with SEPA appeals in Kittitas County. <br /> The proposed changes would clarify the appeal procedures for <br /> each type of SEPA determination. <br /> COMMISSIONER DENEEN asked for clarification on how a decision <br /> gets made between the Growth Management Hearings Board and <br /> Superior Court . LONG RANGE PLANNER JOHNSTON stated he believes <br /> that Growth Management Hearing Board is largely associated with <br /> development regulations and comprehensive plan amendments . If <br /> there is a SEPA associated with a plat, for example, that would <br /> go to Superior Court . <br /> CDS DIRECTOR BALA asked if the Planning Commissioners wanted <br /> another study session or if they felt ready for a hearing next <br /> month on the Short Term Rental document .
