Milestone/Deliverable: Staff technical memo to Board and Planning Commission <br />summarizing analysis and preliminary options by October 14, 2026. <br />Task 2: Option Development & Stakeholder Engagement Timeline: October 15 — January13, <br />2027 <br />Option A — Comprehensive Revision <br />• Specific fixes to purpose statement, receiving site definition and eligibility. Limit <br />primarily to cities and UGAs with demonstrated urban infrastructure/services. <br />• Strictly condition or remove broad rural/PUD/long plat options, exchange rate table and <br />application language (clarify "additional units" on top of underlying zoning; remove or <br />de-emphasize rural category), definitions, and cross-references. <br />• Consider new or amended TDR policies in Rural Element. <br />Option B — Repeal with Transition Provisions <br />(Honor existing certificates for their full term; no new applications) <br />• Prepare comparative white paper (pros/cons, legal/fiscal/implementation implications and <br />GMA alignment). <br />• Conduct stakeholder engagement: meetings with stakeholders (i.e. cities, developers, <br />etc.), and consultation with Planning Commission. <br />• Provide direct notice to holders of existing certificates and current applicants. <br />Milestone/Deliverable: Options white paper + engagement summary to Board by mid - <br />December 2026; Board direction on preferred path by January 13, 2027. <br />Task 3: Drafting & Technical Review Timeline: January 14 — April 14, 2027 <br />• Prepare full draft ordinance based on Board direction (either comprehensive amendments <br />to KCC 17.13 plus any conforming changes, or repeal ordinance with transition <br />language). <br />• Initiate SEPA Review and associated public comment period <br />• Prepare any necessary companion Comprehensive Plan amendments (e.g., consolidated <br />TDR policies in Rural Element). <br />• Full legal sufficiency review and internal consistency check with zoning code, PUD <br />chapter, LAMIRD provisions, and other development regulations. <br />• Complete SEPA documentation and staff report with findings. <br />Milestone/Deliverable: Complete draft ordinance package and staff report ready for <br />Planning Commission review by April 14, 2027. <br />Task 4: Public Review, Recommendation & Adoption Timeline: April 15 — July 14, 2027 <br />
