EXHIBIT A <br />WORK PLAN FOR THE REVIEW, ANALYSIS, AND POTENTIAL REVISION OR <br />REPEAL OF THE TRANSFER OF DEVELOPMENT RIGHTS PROGRAM <br />Kittitas County Community Development Services August 2026 <br />Purpose To provide the Board of County Commissioners with a clear, structured, and time - <br />bound process for evaluating the existing TDR program (KCC Chapter 17.13), directly <br />addressing the deficiencies identified in the Washington State Department of Commerce <br />comment letters dated March 27, 2026 and May 22, 2026, ensuring full consistency with the <br />Growth Management Act (particularly RCW 36.70A.070(5), .110, and .030(38)), coordinating <br />with the 2026 Comprehensive Plan and development regulations updates, and determining <br />whether to comprehensively revise the TDR regulations or repeal the program with appropriate <br />transition measures. <br />Duration August 4, 2026 - August 4, 2027 (one year). The work plan may be updated by Board <br />direction. A subsequent public hearing and new findings would be required for any further six- <br />month renewal. <br />Primary Objectives <br />1. Analyze current TDR code, program history, usage, and outcomes against GMA <br />requirements and Commerce comments. <br />2. Evaluate and compare the two main policy paths (revision vs. repeal). <br />3. Conduct stakeholder and public engagement. <br />4. Produce legally sound, GMA-compliant legislative proposals (amendments or repeal <br />ordinance) ready for Planning Commission and BOCC adoption before moratorium <br />expiration. <br />5. Maintain internal consistency with the adopted 2026 Comprehensive Plan and related <br />updates (PUD, land use/zoning table, housing policies). <br />Task 1: Research, Analysis & Legal Review Timeline: August 4 - October 14, 2026 <br />• Compile complete inventory of existing TDR activity (certificates issued, letters of intent <br />outstanding, transfers completed, and sending/receiving sites involved. <br />• Perform gap analysis of KCC 17.13 against: <br />o Commerce May 22, 2026 comments (definitions in 17.13.015, receiving sites in <br />17.13.030(e)-(g), exchange rate clarity and application in 17.13.080, overall <br />purpose and rural -to -rural risk). <br />o GMA rural character and natural resource land protection standards. <br />o Commerce March 27, 2026 comments on related land use/PUD/LAMIRD issues. <br />• Research TDR best practices and model codes from comparable Washington counties. <br />• Legal review of vested rights, takings exposure, and transition issues if repeal is selected.• J� <br />Assess program effectiveness to date and interaction with the newly adopted 2026 <br />Comprehensive Plan. <br />
