1 Walla Walla County Ordinance No. 468 approved a request by J.R. Simplot <br /> 2 Company (Intervenor), for site specific comprehensive plan and zoning map amendments of <br /> 3 two Simplot properties. The ordinance de-designated the 160-acre property identified as <br /> 4 Parcel A from Primary Agriculture (ALLTCS), changed its land use and zoning designation <br /> 5 to Industrial Agriculture, removed the Unique Lands designation and added this property to <br /> 6 <br /> 7 the Attalia Industrial Urban Growth Area. Further, the ordinance removed another 160-acre <br /> 8 property, identified here as Parcel B, from the Attalia Urban Growth Area, and changed the <br /> 9 land use and zoning from Industrial Agriculture to Primary Agriculture (ALLTCS). This action <br /> 10 effectively traded or exchanged the land use and zoning designations of two properties <br /> 11 located as part of the larger Attalia area, either within or adjacent to the Attalia Industrial <br /> 12 Urban Growth Area, with no net loss of acreage designated ALLTCS. <br /> 13 <br /> Intervenor proposes to build a processing facility on Parcel A, previously designated <br /> 14 <br /> 15 ALLTCS, but applied to offset the loss of farmland through the de-designation of this <br /> 16 particular site by designating Parcel B as Primary Agriculture (ALLTCS). <br /> 17 The chronology of the challenged ordinance is as follows: In December 2016, the <br /> 18 Walla Walla Board of County Commissioners established the criteria and deadline for <br /> 19 applications to be included on the 2017 Preliminary Docket of Comprehensive Plan and <br /> 20 development regulations amendments.' <br /> 21 <br /> 22 A press release that same month by the county announced the 2017 Walla Walla <br /> 23 County Comprehensive Plan and Development Regulation and Amendment Process, listing <br /> 24 the criteria for the types of applications that would be accepted.2 <br /> 25 The County received 3 applications from various locations around the County dealing <br /> 26 with amendments to Agricultural Lands designation, including one from Roberta Cavalli to <br /> 27 de-designate 18.27 acres from agricultural lands, another from Brent Knowles to change the <br /> 28 counties clustering regulations in an AR-10 area, and the proposal for the exchange of <br /> 29 <br /> 30 <br /> designations by J.R.
