1 The County had not adjusted the Urban Growth Area Boundary of the Attalia UGA in <br /> 2 more than five years prior to Ordinance No. 468.4 <br /> 3 The Community Development Staff and Planning Commission held a number of work <br /> 4 shop meetings, public informational meetings and public hearings to discuss amendment <br /> 5 applications and background materials, all of which were open to the public.5 <br /> 6 <br /> 7 Thereafter, in November 2017, the staff presented the Planning Commission's <br /> 8 recommendations on these applications, including the recommendation to deny the Roberta <br /> 9 Cavalli and Brent Knowles proposals and to adopt the J. R. Simplot Company proposal. <br /> 10 Due to an error in the public notice of the hearing, the Board continued the matter to allow <br /> 11 for yet another hearing. During said hearing the Board of County Commissioners voted <br /> 12 unanimously to concur with the Planning Commission's recommendation and to direct staff <br /> 13 <br /> to prepare an ordinance for adoption. Thereafter Ordinance No. 468 was adopted with the <br /> 14 <br /> 15 attached maps (See Appendix B).6 <br /> 16 Procedural matters relevant to the case are detailed in Appendix A. <br /> 17 <br /> 18 II. BOARD JURISDICTION <br /> 19 The Board finds the Petition for Review was timely filed, pursuant to RCW <br /> 20 36.70A.290(2). The Board finds the Petitioner has standing to appear before the Board, <br /> 21 pursuant to RCW 36.70A.280(2)(a) and (b) and RCW 36.70A.210(6). The Board also finds it <br /> 22 has jurisdiction over the subject matter of the petition pursuant to RCW 36.70A.280(1). <br /> 23 <br /> 24 III. STANDARD OF REVIEW <br /> 25 Comprehensive plans and development regulations, and amendments to them, are <br /> 26 <br /> presumed valid upon adoption.'
