GRANTEE',s participating in joint risk pools shall maintain sufficient documentation to support the aggregate claim liability information reported on the balance sheet. The state of 'washington, the Department of commerce, its agents, and employees need not be named as additional insured under a self-insured property/liability pool' if the ioot is prohibited from naming third parties as additional insured. GRANTEE shall provide annually to coMMERCE a summary of coverages and a letter of self- insurance, evidencing continued coverage under GRANTEE's self-insured/liability pool or self- insured risk management program. Such annual summary of coverage and letter of self- insurance will be provided on tne anniversary of the start date of this Grant Agreement' {iashln-q:{itl Staie lv 13. Closeout coMMERCE wiil advise the GMNTEE to initiate closeout procedures when there are no impediments to closing and the following criteria have been met or soon will be met: A. All costs have been incurred with the exception of closeout costs and any unsettled third-party claims against the GRANTEE' B. The GRANTEE has held a public hearing to review program performance' c. The GRANTEE has submitted the contract closeout Report. Failure to submit a report will not preclude COMMERCE from effecting closeout if it is deemed to be in the state's interest' 14. Public Records Act Notwithstanding General Terms and Conditions Section 5 (Confidentiality and _safeguarding of tnformation), COMMERCE is a public agency subject to the Public Records Act, RCW 42'56 (PRA)' Under the PRA, all materials relating to the conduct of government or the performance of any governmental or proprietary function prepared, owned, used, or retained by COMMERCE or its functional equivalents are considered public records. The PRA requires that public records responsive to a public records request be promptly produced unless the PRA or an "other statute" exempts such records from production. This Grant Agreement is not intended to alter CoMMERcE's obligations under the pRA. The parties agree that if COUtUgnCE receives a public records request for files that may include confidential information under General Terms and Conditions Section 5 (Confidentiality Page 10 of25
