SECTION 4 - DEVELOPER'S AGREEMENT FOR ELECTRICAL VAULT & <br />CONDUIT SYSTEM <br />The City of Ellensburg City Light Department will provide high voltage primary and secondary distribution <br />lines to newly developed property within the City Limits and the City's Urban Growth Area (UGA). Charges <br />for the extension of facilities to new developments shall be based on policies, fees, credits and rebates <br />adopted by the City Council and are subject to change at any time. Developers / Landowners must apply <br />for an extension of facilities using the appropriate application and provide all information detailed in <br />Section 4.2, Developer Responsibilities, below, for the City to determine how to provide electrical utility <br />service to the property. The Agreement must be signed, and the invoice paid within 30 days of the date <br />of invoicing. <br />Once the Agreement has been signed by both parties and the invoice has been paid, the Agreement will <br />not be subject to change based on changes to a utility's line extension policy and/or fees adopted by the <br />City Council as long as the construction of the electrical primary, secondary, and street light system has <br />been completed within 365 calendar days of the effective date. If construction of the electrical primary, <br />secondary, and street light system has not been completed after 365 calendar days of the effective date <br />this agreement will expire. If the Developer desires to renew the agreement the Developer will be subject <br />to revised costs, requirements and specifications as determined by City standards current at the time of <br />renewal. <br />4.1 City Utility Responsibilities: <br />1. Install all electric primary & secondary distribution facilities including the electrical <br />primary, secondary, & street lighting vault and conduit system, as well as streetlights, <br />street light posts, street light bases, & street light conductors. <br />2. Design and layout of electrical system within the development based on maps/plans <br />provided by Developer. <br />3. Costs provided to the Developer are based on City crew construction costs or contractor <br />bid costs, depending on state bid laws. <br />4. Provide Developer with a cost estimate including labor, materials, and equipment <br />necessary to provide utility service to the development, done by City crews. <br />5. Provide on -site inspection for key installation milestones detailed in Section 2.3. <br />6. Provide written acceptance or rejection of all work performed by Developer according <br />to Section 2.3, City Inspections. <br />7. Provide specifications for all construction elements to be completed by Developer <br />according to the Agreement. <br />8.
