Article lll . DHS Standard Terms and Condltlons Generally
<br />The FlscalYear (FY) 2023 DHS $tandard Terms and Condltlons apply to all new federalflnanclalasslstance awards tunded
<br />in FY 2023. These terms and conditlons flow down to subrecipients unless an award term or oondition speoifioally lndicates
<br />otherwise, The Unlted States has the rlght to seek Judicial enforcement of these obllgatlons.
<br />All leglslation and digltal resources are referenoed with no dlgital links. The FY 2023 DHS Standard Terms and Conditlons will
<br />be housed on dhs.gov atwww.dhs.gov/publlcatlon/R/15-dhs- standard-terms-and-conditions,
<br />Artlcle lV - Assurances, AdmlnlEtrative Requirements, Cost Prlnclples, Representations and Certifications
<br />l, DHS flnanoial assistance reolpients must oomplete either the Offlce of Management and Budget (OMB) Standard Form
<br />4248 Assuranoes Non-Construation Programs, or OMB $tandard Form 424D Assuranoes Construction Programs, as
<br />appllcable. Certaln assuranoes ln these documents may not be applicable to your program, and the DHs financlal asslstance
<br />offlce (DHS FAO) may requlre applioants to oertiff addltional assurances. Appllcants are requlred to fill out the assurances as
<br />lnstruoted by the awardlng agenoy.
<br />ll. DHS finanoial assistanoe reclpients are required to follow the applioable provislons of the Unlform Admlnlshatlve
<br />Requirements, Cost Principles, and Audlt Requirements for Federal Awards located at Tltle 2, Code of Federal Regulations
<br />(C.F.R.) Part 200 and adopted by DHS at 2 C.F,R, Part 3002.
<br />tll. By accepting this agreement, reclplents, and thelr executives, as defined ln 2 C.F.R. sectlon 170,315, certity that their
<br />pollcles are ln accordance wlth OMBs guidance located at 2 C,F,R. Part 200, all appllcable federal laws, and relevant
<br />Executlve guldance.
<br />Article V , General Acknow,ledgements and Assurances
<br />All reoipients, subreoipients, suooessors, transferees, and assignees must aoknowledge and agree to comply with applioable
<br />provlslons governing DHS aocess to reoords, accounts, documents, lnformatlon, faolllties, and staff,
<br />l. Reoipients must cooperate with any DHS oompliance reviews or compliance lnvestigations conducted by DHS.
<br />ll, Reciplents must give DHS access to examine and copy reoords, acoounts, and other doouments and Bources of information
<br />related to the federal finaqcial assistanoe award and permlt access to facilities or personnel,
<br />lll. Reolplents must submlt timely, complete, and accurate reports to the appropriate DHS officials and maintain appropriate
<br />lV. Reclpients must comply with all other special reporting, data collection, and evaluation requirements, as prescrlbed by law,
<br />or detailed ln program guldance.
<br />V, Reclpients (as defined in 2 C.F.R, Part 200 and inoludlng reolpients aotlng as pass-through entities) of federal financial
<br />asgistance from DHS or one of its awardlng component agencles must complete the DHS Clvil Rlghts Evaluatlon Tool
<br />wlthln thirty (30) days of reoelpt of the Nottce of Award for the flrst award under whlch this term applles. Recipients of
<br />multlple awards of DHS flnancial assistance should only submit one completed tool for thelr organization, not per award.
<br />After the initial submission, recipients are required to complete the tool onoe every two (2) years if they have an active
<br />award, not every time an award is made, Recipients should submit the completed tool, lncludlng supportlng materials, to
<br />ClvilRightsEvaluation@hq.dhs.gov. This tool olarifies the clvll rights obligations and related reportlng requlrements contained
<br />in the DHE Standard Terms and Conditions. Subreciplents are not reguired io complete and submit this toolto DHS. The

<br />Tool I Homeland $ecurity
<br />The DHS Otfice for Civil Rights and Civil Libertieswill considel in its disoretion, granting an extension if the reoiplent
<br />identlfies steps and a timeline for completing the tool. Reciplents should request extensions by emaillng the request to
<br />CivilRlghtsEvaluation@hq,dhs.gov prior to explratlon of the 30-day deadllne.
<br />Article Vl . Acknowledgement of Federal Fundlng from DHS
<br />Recipients must acknowledge their use of federal fundlng when issuing statements, press releases, requests for proposal, bld
<br />lnvitations, and other documents descrlblng proJects or programs funded in whole or in part with federal funds.
