3.4 <br />3.5 <br />3.6 <br />3.7 <br />4.r <br />792CH - Courthouse Union <br />shall be based upon the number of hours worked per week divided by the number of hours in a <br />full working week for the position. <br />Limited Part-Time Employee: An employee hired in a regular position but working less than 20 <br />hours per week on a regular basis. A regular limited part-time employee is entitled to retirement <br />benefits and paid sick leave, but not insurance benefits, other paid leave benefits, or paid <br />holidays; they are paid on an hourly basis. <br />Probationary Employee: An employee hired to fill a regular position as defined in Section 3.2, <br />3.3, or 3.4, who has completed less than the initial six (6) month period of continuous <br />employment. During the probationary period the employee shall be on a trial basis and may be <br />discharged for any reason without recourse to the grievance or arbitration process. Should a <br />probationary employee take an approved unpaid leave of absence of one (1) full week or more, <br />the probationary period shall be extended by the amount of leave taken. <br />Seasonal Employee: An employee hired to fill a position either as full-time or part-time <br />employee not to exceed six (6) months duration in a 12-month period. A seasonal employee <br />shall not be covered by the terms of this Agreement except entry level on the salary schedule <br />Temporary and Casual (On-Call) Employee: An employee hired to fill a short-term or sporadic <br />vacancy caused by (including but not limited to): extended leave situations, unexpected <br />absences, unanticipated excessive workloads, or vacancies of short duration. Temporary <br />employees may work a full-time/40-hour workweek; however, appointments shall not exceed <br />three (3) months duration. The parties agree the three (3) month time limit may be waived by <br />mutual agreement. Casual employees will not maintain a regular work schedule; they will only <br />work as needed to fill temporary vacancies throughout the year. Temporary and Casual <br />employees shall not be covered by the terms of this agreement except entry level on the salary <br />schedule. <br />Neither Temporary or Casual employees will be used to supplant or avoid filling bargaining unit <br />positions. <br />ARTICLE IV - MANAGEMENT RIGHTS <br />The Union recognizes the prerogative of the Employer to operate and manage its affairs in all <br />respects in accordance with its responsibilities, lawful powers and legal authority. All matters <br />not expressly covered by the language of this Agreement shall be administered by the Employer <br />as the Employer may determine. <br />Affairs of the Employer concerning such prerogative include but are not limited to the following <br />matters: <br />The right to establish lawful work rules and procedures <br />The right to schedule work and overtime work, as well as the methods and processes by <br />which said work is to be performed in a manner most advantageous to the Employer <br />and consistent with the requirements of the public interest. <br />A. <br />B. <br />5
