792CH - Courthouse Union <br />I2.3 When a current regular employee applies for a vacancy or newly created position, or when <br />there is a need for curtailment, seniority shall apply between equally qualified employees. <br />"Equally qualified" is defined as having the same level of experience, knowledge, skills, and <br />abilities. Previous reprimands or documented unsatisfactory performance may be considered <br />with the concurrence of Human Resources and the Union. <br />12.4 Seniority shall terminate by discharge from service, by voluntarily leaving service, or by taking a <br />position outside of the bargaining unit. <br />1-2.5 All provisions of seniority bidding shall apply equally to employees of the County clerical unit. <br />72.6 Seasonal and Temporary/Casual employees are not entitled to seniority. Time worked as a <br />seasonal or temporary/casual employee does not count as continuous service with the County <br />t2.7 Anniversary Date: For the purposes of PTO and longevity payout, the anniversary date shall be <br />the last date of hire with the County. For the purpose of annual step increases, the anniversary <br />date shall be the date the employee started their current position (the "position date"). For <br />anniversary dates occurring between the 1't and 15th day of the month, any Step increase will be <br />effective on the first day of that month; for anniversary dates occurring between the 16th and <br />final day of the month, any Step increase will be effective on the first day of the next month. <br />ARTICLE XIII - LAYOFF/RECALL <br />13.1 In the event it becomes necessary to lay off any employee or employees, such layoff shall be by <br />department or office. The least senior employee (as defined in section 12.1) shall be the first <br />employee subject to layoff, provided the remaining employees are qualified and able to perform <br />the work. Employees will be given a 2O-working day notice, when possible, prior to the effective <br />date of layoff. <br />Employees receiving a layoff notice shall be offered the following options: <br />A. Placement on a recall list for the department or division they are leaving; <br />B. lnterview for any open position in another department covered by this Agreement, if the <br />employee meets the minimum and/or special requirements/qualifications, training, or skills <br />required for the position, lf the employee is selected after the interview process the <br />employee will be a probationary employee as defined in Articles 3,5 and 12.2 of this <br />Agreement. <br />Any employee(s) laid off shall be eligible for reinstatement for a period of one (1) year. No new <br />employee(s)shall be hired within the affected department until available and qualified <br />employees on a recall list have been offered re-employment in the reverse order of layoff. <br />To be eligible for re-employment, a laid off employee shall maintain a current address with the <br />employer, and shall be eligible for re-employment only for the period of one (1) year <br />subsequent to the layoff. An offer of re-employment shall be in writing and sent by registered <br />or certified mail to the employee at the address provided by the employee. An employee shall <br />13
