The Employer retains broad authority to fulfill and implement its <br />responsibilities and may do so by oral or written work rule, existing or future; <br />To create shifts, workdays, hours of work and work locations; <br />To designate and assign all work duties; <br />To introduce new and revise existing duties within the bargaining unit; provided, <br />however, the Employee will notifli the Union of any change in the essential functions of <br />any existing bargaining unit job description prior to the implementation of the change; <br />To discipline, suspend, demote, or discharge an employee, including but not limited to: <br />unsatisfactory work performance, violation of County rules and/or policies or any other <br />conduct deemed inappropriate or adverse to the Employer's ability to operate <br />efficiently and productively; <br />To determine the need for additional educational courses, training programs, on-the-job <br />training, and cross-training, and assign employees such duties for period to be <br />determined by the Employer; <br />To take whatever actions the Employer deems necessary to carry out services in an <br />emergency. The Employer shall be the sole determiner as to the existence of an <br />emergency and any and all actions necessary to implement service during said <br />emergency. <br />This list is not an all-inclusive list of all the Employer's rights, functions, prerogatives, or <br />authority, but only serves as a general guide. The Employer expressly reserves, and the Union <br />agrees that the Employer retains all customary, usual, and exclusive rights as set out in Sections <br />2.2 and 2.3 of this Agreement, unless expressly set forth to the contrary in this Agreement. <br />Nothing in this Agreement shall be interpreted to detract or circumscribe the trust placed in the <br />Board of Kittitas County Commissioners and/or other elected officials and/or department heads, <br />and the rights and duties owed thereby to the citizenry. <br />Exclusions. Unless mutually agreed otherwise, work performance evaluations are specifically <br />excluded from coverage of the grievance procedure set out in Article 24 of this Agreement. <br />ARTICLE 4 - NEGOTIATIONS AND/OR CONFERENCES <br />Negotiations shall occur on work time at mutually agreeable times not to unduly interrupt the <br />normal functioning of the County. Two (2) Union officials who are employees in the bargaining <br />unit shall be granted time off without loss of pay for negotiations. ln the event negotiations <br />extend past the normal workday as set forth in Article 5 and the Employer agrees that <br />continuing the negotiation process would be advantageous to reaching an agreement the <br />Employer agrees to compensate employees as set forth in Article 5.1 of this Agreement. <br />K. <br />L. <br />M <br />N <br />o <br />3.4 <br />3.5 <br />3.6 <br />4.L <br />6
