Architect, shall be at the Contractor's risk and the settlement of any complications <br />or disputes arising therefrom shall be at the Contractor's sole expense. <br />3.3 SUPERVTSION AND CONSTRUCTION PROCEDURES: ADD the following subparagraphs to <br />Article 3.3: <br />3.3.2 ADD the following text: <br />Coordinate work of all subcontractors. <br />3.3.4 Add the following new subparagraph 3.3.4: "The Contractor shall be solely <br />responsible for any claims for wages or compensations by the Contractor's <br />employee, agents, representatives, including subcontractors, and shall save and hold <br />the Owner harmless therefrom." <br />3.3.5 Add the following Subparagraph 3.3.5: All grades, levels, bench marks, locations and <br />corners shall be correctly verified by the Contractor. <br />3.4 ADD the following new subparagraphs and clauses: <br />LABOR AND MATERIALS: ADD the following subparagraph to Article 3.4: <br />3.4.I.t The Contractor shall be solely responsible for all materials and <br />equipment until the completed project is delivered and accepted by the <br />Owner. The Contractor shall, at his own expense, secure and maintain a <br />storage area for his materials and equipment." <br />Add the following Subparagraphs 3.4.2.1 and 3.4.2.2 <br />3.4.2.L After the Contract has been executed the Owner and the Architect will <br />consider a formal request for the substitution of products in place of those <br />specified only under the following conditions set forth in the General <br />Requirements (Division 1 of the Specifications). <br />.L Required product cannot be supplied in time for compliance with Contract <br />time requirements. <br />.2 Required product is not acceptable to governing authority, or determined to <br />be non- compatible, or cannot be properly coordinated, warranted, or <br />insured, or has other recognized disability as certified by Contractor. <br />.3 Substantial advantage is offered Owner after deducting offsetting <br />disadvantages including delays, additional compensation to <br />Architect/Engineer for redesign, investigation, evaluation, and other <br />necessary services, and similar considerations. <br />3.4.2.2 By making requests for substitutions based on Subparagraph 3.4.3 above, the <br />Contractor: <br />.1 represents that the Contractor has personally investigated the proposed <br />substitute product and determined that it is equal or superior in all respects to <br />that specified; <br />.2 represents that the Contractor will provide the same warranty for the <br />substitutions that the Contractor would for that specified; <br />.3 certifies that the cost data presented is complete and includes all related costs <br />under this contract, except the Architect's redesign costs, and waives all claims <br />for additional costs related to the substitution which subsequently become <br />apparent; and <br />Kittitas County - Lower ValleY <br />Transfer Station <br />Supplementary General <br />Conditions of the Contract <br />June 18, 2024 <br />3of24
