.4 will coordinate the installation of the accepted substitute, making such <br />changes as may be required for the work to be complete in all respects. <br />3,4.2.3 Submit request for substitution utilizing the Substitution Request Form located <br />in Section 01 25 00. <br />3.4.4 After the Contract has been executed, the Owner and the Architect will <br />consider a formal request for the substitution of products in place of those <br />specified only under the conditions set forth in the General Requirements <br />(Division L of the Specifications). <br />3.4.5 By making requests for Substitutions based on Subparagraph 3.4.3 above, the <br />Contractor: <br />.1 represents that the Contractor has personally investigated the proposed <br />substitute product and determined that it is equal or superior in all respects to <br />that specified; <br />.2 represents that the Contractor will provide the same warranty for the <br />substitution that the Contractor would for that specified; <br />.3 certifies that the cost data presented is complete and includes all related costs <br />under this Contract except the Architect's redesign costs, and waives all claims for <br />additional costs related to the substitution which subsequently become apparent; <br />and <br />.4 will coordinate the installation of the accepted substitute, making such changes <br />as may be required for the Work to be complete in all respects. <br />3.5 WARRANTY <br />3.5.L REVISE the sentence "Work, materials or equipment not conforming to these requirements, may be <br />considered defective." to read as follows: <br />Work not conforming to these requirements, including substitutions not properly approved <br />and authorized, shall be considered defective. <br />3.5.1 DELETE the phrase "lf required by the Architect" from the last sentence so that it reads: The Contractor <br />shall furnish satisfactory evidence as to the kind and quality of materials and equipment. <br />3.5.1 Add the following sentence to the end of Subparagraph 3.5'L: <br />The Contractor shall maintain such warranty for a period of one (1) year from the date of Substantial <br />Completion of the project not withstanding more extensive warranty requirements specified for certain <br />elements and products used in the work in which case the longer warranty requirement shall apply. <br />TAXES: ADD the following to Paragraph 3.6.1: <br />The contract sum and any agreed variations thereof shall include all taxes imposed by law, and properly <br />chargeable to the project except Sales Tax. Sales Tax applicable to the contract sum will be collected from the <br />Owner and shall be paid to the State Department of Revenue by the Contractor in conformance with the law. <br />State of Washington Sales Tax shall not be included in the bid price, except that the retail sales tax upon sales <br />and rentals to prime contractors and subcontractors of tools, machinery and equipment, and consumable <br />supplies, such as hand and machine tools, cranes, air compressors, bulldozers, lubricating oil, sandpaper and <br />form lumber which are primarily for use by the Contractor rather than for resale as a component part of the <br />Kittitas County - Lower ValleY <br />Transfer Station <br />Supplementary General <br />Conditions of the Contract <br />June 18, 2024 <br />4of24
