Again, the purpose of this application for a <br />Development Agreement is to establish a timeline for the development and <br />construction of the Planned Unit Development. <br />4. In response to the comments from Russell Mau with the Department of Health <br />dated June 2Wh, 2024, we would like to clarify that this application for the <br />Development Agreement does not alter the requirements set forth in Kittitas <br />County Ordinance 2006-59 nor the Ranch on Swauk Creek Final'Development <br />Plan as approved by Resolution Number 2017-073. However, we acknowledge <br />that a Group A domestic water system is required for the development of the <br />Ranch on Swauk Creek Planned Unit Development. A Group A water system plan <br />under the Hidden Valley Water System has been approved by the Department of <br />Health for the Ranch on Swauk Creek Planned Unit Development. This system <br />currently serves the Swauk Pines Development, the Ranch Road Development. <br />the Ranch on Swauk Creek Planned Unit Development, and the Dunford Planned <br />Unit Development (RZ-07-00008). All these developments, either currently in <br />existence or planned and approved for future development, are included within <br />the boundaries of the approved Group A water system. Portions of the system <br />have been constructed and all plans for future development of the Group A water <br />system have been approved by the Department of Health. <br />5. In response to the comments from Brad Kahn dated July 26th, 2024, we would <br />like to clarify that this application for the Development Agreement does not alter <br />the requirements set forth in Kittitas County Ordinance 2006-59 nor the Ranch on <br />Swauk Creek Final Development Plan as approved by Resolution Number 2017- <br />073. The area adjacent to Swauk Creek has been placed in open space and will <br />continue to be farmed and ranched as it has been for over 130 years. The project <br />will meet the Dark Skies initiative and the Kittitas County Noise Ordinance in KCC <br />9.45. Regarding fire risks, the project will meet all of the requirements set forth in <br />Kittitas County Ordinance 2006-59 and the Ranch on Swauk Creek Final <br />Development Plan as approved by Resolution Number 2017-073. <br />6. In response to the comments from Genevieve Sedgwick dated July 111h and July <br />25th, 2024, we would like to clarify that this application for the Development <br />Agreement does not alter the requirements set forth in Kittitas County Ordinance <br />2006-59 nor the Ranch on Swauk Creek Final Development Plan as approved by <br />Resolution Number 2017-073. The Ranch on Swauk Creek owns two parcels that <br />are legally accessed from Fir Tree Drive with those being Parcel 12A, Book 33 <br />Pages 17-18 and Parcel 13, Book 25 Pages 206-211 as filed with the Kittitas <br />County Auditor. Only domestic development on those two parcels will be <br />accessed by Fir Tree Drive. The development and construction of the Ranch on <br />Swauk Creek Planned Unit Development will meet all requirements that were <br />approved without appeal in Kittitas County Ordinance 2006-59 and the Ranch on <br />Swauk Creek Final Development Plan as approved by Resolution Number 2017- <br />073. Lots 12A and 13, as noted above, are not included within the lands affected <br />by the Lauderdale Ridge Homeowners Association. The access easement <br />granted to Lots 12A and 13, as noted above, provides us with free and open <br />access to and from our property and is outside of the control of the Lauderdale <br />Ridge Homeowners Association. <br />
