Memo to: Jamie Ayling, Planning Manager, Kittitas County <br />Date August 12, 2024 <br />Subject: Development Agreement Approval for Ranch on Swauk Creek Planned Unit <br />Development (RZ-06-00027) <br />Response to comments received: <br />We are submitting this response to comments received from the public regarding the <br />approval of a Development Agreement related to the previously reviewed and approved <br />Ranch on' Swauk Creek Planned Unit Development (RZ-06-00027). This Development <br />Agreement application does not alter any of the existing requirements for the <br />completion of the Planned Unit Development outlined in the original approval. This <br />application for a Development Agreement only modifies the time frame within which the <br />actual development and construction process will occur. All conditions remain <br />consistent with those approved by Ordinance 2006-59, dated December 5, 2006, and the <br />Ranch on Swauk Creek Final Development Plan as approved by Resolution Number <br />2017-073. <br />1. In response to the comments from the Department of Natural Resources dated <br />June 28th, 2024, we would like to clarify that this application for the Development <br />Agreement does not after the requirements set forth in Ordinance 2006-59 nor <br />the Ranch on Swauk Creek Final Development Plan as approved by Resolution <br />Number 2017-073. However, we acknowledge that a Forest Practices Application <br />may be necessary before construction occurs within the project boundaries. <br />2. In response to the comments from the Department of Archaeology and Historic <br />Preservation dated July 81h, 2024 and the Yakama Nation dated July 3'd 2024, we <br />would like to clarify that this application for the Development Agreement does <br />not alter the requirements set forth in Ordinance 2006-59 nor the Ranch on <br />Swauk Creek Final Development Plan as approved by Resolution Number 2017- <br />073. The area covered by this application for a Development Agreement is the <br />same as that which was proposed and approved in the Ranch on Swauk Creek <br />Planned Unit Development through Ordinance 2006-59 and the Ranch on Swauk <br />Creek Final Development Plan as approved by Resolution Number 2017-073. <br />During the process of developing and constructing the approved Ranch on Swauk <br />Creek Planned Unit Development, we will meet or exceed all the vested rights that <br />were included within the said approval of Ordinanceapproved b2006-59 aon Number 2017- <br />nd the Ranch on <br />Swauk Creek Final Development Plan as y Resolution <br />073. <br />3. In response to the comments from the Bonneville Power Administration dated <br />July 261h, 2024, we would like to clarify that this application for the Development <br />Agreement does not alter the requirements set forth in Ordinance 2006-59 nor <br />the Ranch on Swauk Creek Final Development Plan as approved by Resolution <br />Number 2017-073. However, we acknowledge that all development within the <br />easement that has been granted to the Bonneville Power Administration will need <br />to be reviewed and approved by them prior to initiating any construction or <br />
