2024-09 <br /> 12.04.04.050 Private Roads. <br /> Although community local access roads are usually best served by public roads,controlled and <br /> maintained by the county,private roads may be appropriate for some local access roads for <br /> residential,commercial,or industrial uses.At the discretion of the county engineer,proposed <br /> private roads within an adopted Urban Growth Area(UGA)may defer to the associated city's <br /> development standards in the absence of a variance process. <br /> A Civil Review of the private road plans shall be submitted accepted and approved by Public <br /> Works prior to construction of a private road Private road plans shall meet the requirements of <br /> Article X Construction Plan Submittals A Civil Review shall not be required when an engineered Formatted:Font:Italic <br /> grading permit is submitted for the road improvements <br /> Roads will be approved as private roads instead of public when all of the following conditions are <br /> met <br /> A. The road is not deemed to be a necessary part of a present or future public neighborhood <br /> circulation plan adopted in the Kittitas County comprehensive plan,transportation plan, <br /> applicable community plans,or capital improvement plans. <br /> B. The road shall be permanently established by right-of-way,tract,or easement providing <br /> legal access to each affected lot,dwelling unit,or business and sufficient to <br /> accommodate required maintenance and improvements. <br /> C. Any private road serving as access to five lots or more shall file a maintenance agreement <br /> appurtenant to all the property owners having a vested interest in the private road prior to <br /> recording the final plat with the Kittitas County auditor's office with a copy to be provided <br /> to the Kittitas County Building Department and Kittitas County Public Works.Reference <br /> the auditor's file number on the plat.The maintenance and upgrading agreement shall <br /> provide for a funding mechanism that provides for road maintenance of private roads and <br /> associated parking areas by a capable and legally responsible owner,homeowners' <br /> association or other legal entity made up of all benefited property owners.The term <br /> "benefited property owners"shall include the owners of record of all properties with <br /> frontage,including access rights,on the private road or otherwise have legal access, <br /> whether constructed or not,to the private road. <br /> D. Private roadway signs may either be provided by the applicant or by the department of <br /> public works.A signing and striping plan,per KCC 12.04.11.060(Submittal Procedure) <br /> shall be submitted and approved prior to any sign installation.Names for private roads <br /> shall be approved by the County Engineer and vetted by KITTCOM. <br /> E. The placement of utilities shall be coordinated as much as possible with the placement of <br /> private roads and public rights-of-way. <br />
