31. PrevaitingWage: <br />The Contractor shatt pay the prevaiting rate of wages to atl' workers, [aborers, or mechanics <br />empl,oyed in the performance of any part of the Work in accordance with RCW 39'1 2 and <br />the rules and reguLations of the Department of Labor and lndustries' The schedute of <br />prevaiting wages rates for the tocatity or locatities of the Work is determined by the <br />lndustrial, Statistician of the Department of Labor and lndustries. lt is the Contractor's <br />responsibitity to verify the appticabte prevaiting wage rate. lt is understood that the <br />contractor is responsibte for obtaining and compteting att required government forms and <br />submitting same to the proper authorities. <br />Disputes regarding prevaiting wage rates shatt be referred for arbitration to the Director of <br />the Department of Labor and lndustries. The arbitration decision shatl' be finaI and <br />conclusive and binding on att parties invotved in the dispute as provided for by RCW <br />39.12.060. <br />32. Debarment Certification: <br />The Contractor certifies that it: <br />32.1 ls not presentty debarred, sr1spended, proposed for debarment, declared <br />inetigibte or votuntarity exctuded from covered transactions by any FederaI <br />dePartment or agencY. <br />32.2 Has not within a three-year period preceding the execution of this contract <br />with Kittitas County, been convicted of or had a civit judgment rendered <br />against them for commission of f raud or a criminal offense in connection <br />with obtaining, attempting to obtain, or performing a pubtic or private <br />agreement or transaction, viotation of Federat or State antitrust statutes or <br />commission of embezztement, theft, forgery, bribery, fatsification or <br />destruction of records, making fatse statements, tax evasion, receiving <br />stolen property, making fatse cl,aims, or obstruction of justice. <br />32.3 ls not presentty indicted for or otherwise criminatty or civitty charged by a <br />governmentat entity (Federat, State, or Local,) with commission of any of the <br />offensesenumeratedinparagraph32.2ofthissection' <br />g2.4 Has not within a three-year period preceding the preceding the execution of <br />this contract with Kittitas County had one or more pubtic transactions <br />(Federa[,state,orlocat)terminatedforcauseofdefau[t. <br />Kittitas Cou nty Prof essionaI Services Agreement <br />Pagel3oflB
