Waiver of any breach or condition of this Agreement shalt not be deemed a waiver of any prior
<br />or subsequent breach. No terms or conditions of this Agreement shatt be hetd to be waived,
<br />modified or del,eted except by an instrument, in writing, signed bythe parties hereto.
<br />29. Survivat:
<br />The provisions of paragraphs 7,9,11,13,14,15, 16, 17,18,19,20,21,22,23,24,28,30, and
<br />31 ,32 shatl, survive, notwithstanding the termination or inval,idity of this Agreement for any
<br />reason.
<br />30. Nondi-serxrnaflon:
<br />30.1 The County is an equaI opportunity emptoyer.
<br />30.2 NondiscriminationinEmptoyment
<br />ln the performance of this Agreement, the Contractorwitl notdiscriminate
<br />against any empl.oyee or appticant for emptoyment on the grounds of race,
<br />creed, cotor, nationaI origin, sex, sexuaI orientation, maritaI status, age or
<br />the presence of any Sensory, mentaI or physical. handicap; provided that
<br />the prohibition against discrimination in emptoyment because of
<br />handicap shal.L not appLy if the particular disabitity prevents the proper
<br />performance of the particutar worker invotved. The Contractor shatl ensure
<br />that app[icants are emptoyed, and that emptoyees are treated during
<br />employmentwithout discrimination because of their race, creed, color,
<br />nationat origin, sex, sexuaI orientation, maritaI status, age or the presence of
<br />any sensory, mentat or physicaL handicap. Such action shatl inctude, but
<br />not be timited to: emptoyment, upgrading, demotion ortransfers,
<br />recruitment or recruitment advertising, tayoff or termination, rates of pay
<br />or other forms of compensation, and programs fortraining inctuding
<br />apprenticeships. The Contractor shall take such action with respect to
<br />this Agreement as may be required to ensure ful.t comptiance with locat,
<br />state and federal. Laws prohibiting discrimination in emptoyment.
<br />30.3 Nondiscrimination in Services
<br />The Contractor witl, not discriminate against any recipient of any services or
<br />benefits provided for in this Agreement on the grounds of race, creed,

<br />presence of any sensory, mentaI or physicat handicap.
<br />30.4 lf any assignment and/or subcontracting has been authorized by the County,
<br />said assignment or subcontract Shatl, inctude appropriate safeguards against
<br />discrimination. The Contractor shatttake such action as may be required to
<br />ensure ful,t compl.iance with the provisions in the immediatety preceding
<br />paragraphs herein.
