ffi <br />98-BJ-G478-3 023857 <br />'"!;#132 <br />(a) Remove the ash, dust or particulate mafter from the interior and exterior surfaces of the covered building; <br />and <br />(b) Clean equipment and stock. lf stock cannot be returned to its state before the volcanic eruption, the meas- <br />ure of loss will be the reduction in actual cash value. <br />Payment for removal applies only to the initial deposit of ash, dust or parliculate matter following a volcanic <br />eruption. Subsequent deposits arising from the movements of volcanic dust or ash by wind or othei means are <br />not covered. <br />(4) Does not include loss caused by, resulting ftom, conhibuted to or aggravated by: <br />(a) Fire; <br />(b) Explosion; <br />(c) Flood,surfaceuater,uaves,tides,tidaluaves,tsunami,seiche,overfowofanybodyofwater,ortheirspray, <br />all whether driven by wind or not; or <br />(d) Earth movement, as described in Paragraph 't.b. of SECTION I - EXCLUSIONS. <br />6. Throughout SECTION l, the term "vehicles" means vehicles running on land or tacks, but not aircrafi. <br />B. SECTION ll is amended as folloun: <br />1. Throughout SECTION ll and any endorsement or addition that would modifu this section, the term "spouse" is replaced <br />with the following; <br />Spouse or individual who is in a domestic partnership recognized under Washington law <br />2. Paragraph 5. Employer's Liability of SECTION ll - EXCLUSIONS applies only to "bodily injury" to "employees" of the <br />hsured whose employment is not subject to the lndustrial lnsurance Act of Washington (Washington Revised Code Title <br />51) <br />With respect to "bodily injury" to "employees" of the insured whose employment is subject to the lndustial lnsurance Act <br />of Washington, paragraph 5., is replaced by the following: <br />5. Employer'sLiability <br />a. "Bodily injury" to an "employee" or a former "employee" of the insured arising out of and in the course of: <br />(1) Employment by the insured; or <br />(2) Performing duties related to the conduct of the insured's business. <br />b. Any obligation to share damages with or repay someone else who must pay damages because of the injury. <br />This exclusion does not apply to liability assumed by the insured under an "insured conhact". <br />3. Paragraph 2.a.(1) of SECTION ll - WHO lS AN INSURED applies only to "employees" of the insured whose employment <br />is not subject to the lndushial lnsurance Act of Washington (Washington Revised Code Title 51). <br />Wih respect to "employees" of tre insured whose employment is subject to fre lndustrial lnsurance Act of Washington, Para- <br />graph 1.b.(1xa) is replaced by tre following: <br />(a) "Bodi! injury'' or "personal and advertising injury'': <br />i. To you, to your partners or members (if you are a partnership or joint venture), to your members (if you're a <br />limited liability company), or to a co-'employee" while that co-"employee" is eifher in the course of hi-s or her <br />employment or performing duties related to the conduct of your business; or <br />ii. For which there is any obligation to share damages with or repay someone else who must pay damages be- <br />cause of the injury described in Paragraph i. above. <br />C. SECTION IAND SECTION ll- COMMON POLICY CONDITIONS is amended as follows. <br />1. The following is added to 2.
