<br />DHS/FEMA funded activities ihat may require an Environrnental Planning and Historio Preservation (EHP) review are subjeot
<br />to the FEMA EHP review process, This review does not address all federal, etate, and local requlrements. Acceptance of
<br />federal funding requlres the reclplent to comply with all federal, state and local laws.
<br />DH$/FEMA is required to consider the potential lmpacts to natural and cultural resources of all proJects funded by DHS/
<br />FEMA grant funds, through its EHP revlew process, ae mandated by: the Natlonal Environmental Policy Act; National Historlo
<br />Preseryation Aot of 1966, as amended; Natlonal Flood lnsurance Program regulatlons; and any other applicable laws and
<br />exeoutive orders, General guidance for FEMA's EHP proce6e is avallable on the DHS/FEMA Webslte, Specific appllcant
<br />guldance on how to submlt informatlon for EHP review depends on the lndivldual grant program and applicants should contaot
<br />their grant Program officer to be pLrt lnto contact wlth EHP staff responslble for assigting their specific grant program, The
<br />EHP review process must b€ completed before funds are released to catry out the proposed proJect; otherwlse, DHS/FEMA
<br />may not be able to fund the proJect due to noncompllance with EHP laws, exeoutive ordere, regulatlons, and policles.
<br />lf ground disturblng aotivities occur during constructlon, applloant wlll monltor ground disiurbance, and if any potential
<br />archaeological resources are discovered the applioant wlll lmmedlately oease work ln that area and notify the pass-through
<br />entity, if applloable, and DHS/FEMA.
<br />Artlcle XLVI - Applicability of DHS Standard Terms and Condltions to Trlbes
<br />The DHS Standard Terms and Conditions are a restatement of general requirements lmposed upon reciplents and flow down
<br />to sutrrecipients as a mafter of law, regulation, or executive order. lf the requkement does not apply to lndian tribes or there
<br />ls a federal law or regulation exemptlng its applioatlon to lndian trlbes, then the acoeptance by Tribes of, or acquiescenoe
<br />to, DHB Standard Terms and Conditions does not change or alter lts lnapplioability to an lndian tribe. The execution of gmnt
<br />documents ls not intended to change, alter, amend, or impoee addltionai liability oi responsibillty upon the Tribe where it does
<br />not already exlst.
<br />Artlcle XLVII - Acceptance of Post Avraard Changes
<br />ln the event FEMAdetermines,that changes are necessary to the award document aft6r an award has beon made, lncludlng
<br />ohanges to perlod of performance or terrns and condltlons, reclplents wlll be notified of the ohanges ln writing, Once
<br />notifioatlon has been made, any subsequent request for funds will lndicate recipient acoeptance of the changes to lhe

<br />Aillcle XLVlll . Disposition of Equipment Acqulred Under the Federal Auard
<br />For purposes of original or replaoement equipment acqulred under thle award by a non"state recipient or non-state sub-
<br />reoipients, when that equlpment is no longer needed for the original proJect or program or for other activitles currently or
<br />previously supported by a federal awarding agenoy, you muet request instructlons from FEMA to make proper disposition
<br />of the equipment pursuant to 2 C.F.R. sectlon 200.313. State realpients and state sub-reoipients must follow the disposition
<br />requirements in accordance with state laws and proceduree.
<br />Artlcle XLIX - Prlor Approval for Modificatlon of Approved Budget
<br />Before making any change to the FEMA approved budget for this award, you must request prior written approval from FEMA
<br />where required by 2 C.F.R, section 200.308,
<br />For purposes of non-construction projeots, FEMA ls utillzing its dlscretlon to lmpose an addltional restrlotion under 2 C.F,R.
<br />section 200,308(D regarding tho transfer of funds among direot cost categories, programs, funotions, or aotivitles. Therefore,
<br />for awards with an approved budget where the federal share ls greator than the simpllfied acqulsltion threshold (currently
