2023 Docket Enabling Ordinance December 19, 2023 <br />Page 52 <br /> <br /> <br />complying with the conditions of the permit, the approved plans, or applicable portions <br />of these standards, the County may revoke the original permit and/or order work <br />stopped on the project. Examples of reasons why the County may order all or part of the <br />permitted work stopped include but are not limited to the following: <br />1. The applicant failed to comply with the conditions of the permit, the approved <br />plans, SEPA or other environmental permit conditions, or applicable portions of <br />these standards; <br />2. The permit was granted based on erroneous or incomplete information submitted <br />to the county by the applicant or the applicant’s engineer or agent; <br />3. Weather conditions caused off-site or downstream drainage problems; <br />4. The work has created, is adjacent too, or otherwise associated with, a condition that <br />is a hazard to life, endangers property, or adversely affects the use or stability of a <br />public way or drainage course. <br />E. Cease and Desist Orders: The County may serve a cease and desist order for violations <br />of this chapter. The order shall include the following: <br />1. Description of violation; <br />2. Effective date, such as immediately upon receipt by the person to whom the order <br />is directed; <br />3. Compliance outcome, such as failure to comply with terms of a cease and desist <br />order can result in enforcement action including but not limited to issuance of a <br />civil infraction citation; and <br />4. Corrective measures, the affected party may request one meeting with the County <br />Engineer within 20 days of receipt of the cease and desist order. The affected party <br />may request one subsequent meeting with the Public Works Director. <br />F. Civil Infraction. Any person, firm, or corporation violating any provisions of these <br />standards shall be deemed guilty of a misdemeanor, and upon conviction thereof shall <br />be punished by a fine of not more than $1,000.00 or by imprisonment for not more than <br />90 days as set forth in KCC Title 18. Each person, firm, or corporation found guilty of a <br />violation shall be deemed guilty of a separate offense for each and every day during any <br />portion of which any violation of any provision of these standards is committed, <br />continued or permitted by such person, firm, or corporation and shall be punished <br />therefor.
