2023 Docket Enabling Ordinance December 19, 2023 <br />Page 51 <br /> <br /> <br /> <br />UTILITY - A company or individual providing public service such as gas, electric power, irrigation, <br />telephone, Internet, water, sewer or cable television, whether or not such company is privately <br />owned or owned by a governmental entity. <br /> <br />VARIANCE – A departure from these standards. <br /> <br />WORKING DAYS – Days on which the Department of Public Works is open for business, typically <br />including Monday thru Friday, not including holidays. <br /> <br />12.01.050 Authority and Enforcement. <br />The Director of Public Works and/or the County Engineer or his/her designee shall have the <br />authority, on behalf of the County, to ascertain that all design and construction complies with <br />the requirements set forth in these Standards. <br /> <br />It shall be the duty of the Board of County Commissioners, acting through the Director of Public <br />Works or his/her designee, to enforce the provisions of this title. <br /> <br />12.01.060 Violations and Penalties. <br />The County shall have the authority to impose penalties and take other specific actions in <br />response to violations of the code and non-compliance with these standards. <br />A. The County may withhold or withdraw approval of project plans, require the forfeiture of <br />the financial guarantee submitted to the County, and/or issue non-acceptance of <br />portions of the work. <br /> <br />B. The County may require the applicant or property owner to remove or replace illegal <br />earthwork and/or other items associated with these standards that were not properly <br />permitted. <br />C. The County shall have the authority to enforce these standards including the design and <br />construction guidance that is referenced in this section. The County will appoint project <br />engineers, assistants, and inspectors as necessary to inspect the work and they will <br />exercise such authority as the Director of Public Works and the County Engineer may <br />delegate. <br />D. Stop Work Orders: Should the County become aware of conditions that invalidate the <br />original design data used to obtain the permit or determine that the applicant is not
