7.SUBRECIPIENTMONITORINGa.TheDepartmentwillmonitortheactivitiesoftheSubrecipientfromawardtocloseout.ThegoaloftheDepartment'smonitoringactivitieswillbetoensurethatagenciesreceivingfederalpass-throughfundsareincompliancewiththisAgreement,federalandstateauditrequirements,federalgrantguidance,andapplicablefederalandstatefinancialregulations,aswellas2CFRPart200SubpadF.b.Todocumentcompliancewith2CFRPart200SubpartFrequirements,theSubrecipientshallcompleteandreturntotheDepartmentanAuditCertification/FFATAform.Thisformisrequiredtobecompletedoncepercalendaryear,perSubrecipient,andnotperagreement.TheDepadment'sContractsOfficewillrequesttheSubrecipientsubmitanupdatedformatthebeginningofeachcalendaryearinwhichtheSubrecipienthasanactiveagreement.c.Monitoringactivitiesmayinclude,butarenotlimitedto:i.Reviewoffinancialandperformancerepods;ii.MonitoringanddocumentingthecompletionofAgreementdeliverables;iii.Documentationofphonecalls,meetings(e.g.,agendas,sign-insheets,meetingminutes),e-mails,andcorrespondence;iv.ReviewofreimbursementrequestsandsupportingdocumentationtoensureallowabilityandconsistencywithAgreementWorkPlan(AttachmentsD-1,D-2,D-3),Budget(AttachmentE),andfederalrequirements;v.ObservationanddocumentationofAgreement-relatedactivities,suchasexercises,training,events,andequipmentdemonstrations;andvi.On-sitevisitstoreviewequipmentrecordsandinventories,toverifysourœdocumentationforreimbursementrequestsandperformancereports,andtoverifycompletionofdeliverables.d.TheSubrecipientisrequiredtomeetorexceedthemonitoringactivities,asoutlinedabove,foranynon-federalentitytowhichtheSubrecipientmakesasubawardasapass-throughentityunderthisAgreement.e.Compliancewillbemonitoredthroughouttheperformanceperiodtoassessrisk.Concernswillbeaddressedthroughacorrectiveactionplan.8.LIMITEDENGLISHPROFICIENCY(CIVILRIGHTSACTOF1964TITLEVI)TheSubrecipientmustcomplywiththeTitleVIoftheCivilRightsActof1964(TitleVI)prohibitionagainstdiscriminationonthebasisofnationalorigin,whichrequiresthatsubrecipientsoffederalfinancialassistancetakereasonablestepstoprovidemeaningfulaccesstopersonswithlimitedEnglishproficiency(LEP)totheirprogramsandservices.ProvidingmeaningfulaccessforpersonswithLEPmayentailprovidinglanguageassistanceservices,includingoralinterpretationandwrittentranslation.ExecutiveOrder13166,ImprovingAccesstoServicesforPersonswithLimitedEnglishProficiency(August11,2000),requiresfederalagenciestoissueguidancetorecipients,assistingsuchorganizationsandentitiesinunderstandingtheirlanguageaccessobligations.DHSpublishedtherequiredrecipientguidanceinApril2011,DHSGuidancetoFederalFinancialAssistanceRecipientsRegardingTitleVIProhibitionagainstNationalOriginDiscriminationAffectingLimitedEnglishProficientPersons,76Fed.Reg.21755-21768,(April18,2011).TheGuidanceprovideshelpfulinformationsuchashowarecipientcandeterminetheextentofitsobligationtoprovidelanguageservices,selectinglanguageservices,andelementsofaneffectiveplanonlanguageassistanceforLEPpersons.Foradditionalassistanceandinformationregardinglanguageaccessobligations,pleaserefertotheDHSRecipientGuidanceathttps://www.dhs.qov/quidance-published-help-depadment-suppoded-organizations-provide-meaninqful-access-people-limitedandadditionalresourcesonhttps://www.lep.cov.9.NIMSCOMPLIANCEa.TheNational[ncidentManagementSystem(NIMS)identifiesconceptsandprinciplesthatanswerhowtomanageemergenciesfrompreparednesstorecoveryregardlessoftheircause,size,location,orcomplexity.NIMSprovidesaconsistent,nationwideapproachandvocabularyforDHS-FEMA-HSGP-SHSP-FY22Page8of44KittitasCounty,E23-116
