multipleagenciesorjurisdictionstoworktogethertobuild,sustain,anddeliverthecorecapabilitiesneededtoachieveasecureandresilientnation.b.ConsistentimplementationofNIMSprovidesasolidfoundationacrossjurisdictionsanddisciplinestoensureeffectiveandintegratedpreparedness,planning,andresponse.NIMSempowersthecomponentsoftheNationalPreparednessSystem,arequirementofPresidentialPolicyDirective8,toguideactivitieswithinthepublicandprivatesectoranddescribestheplanning,organizationalactivities,equipping,training,andexercisingneededtobuildandsustainthecorecapabilitiesinsupportoftheNationalPreparednessGoal.c.InordertoreceivefederalpreparednessfundingfromtheDepartment,theSubrecipientmustachieve,orbeactivelyworkingtoachieve,alloftheNIMSImplementationObjectiveslocatedathttps://www.fema.govlemergency-managers/nimslimplementation-training.B.HSGPSPECIFICREQUIREMENTS1.TheSubrecipientmustuseHSGPfundsonlytoperformtasksasdescribedintheWorkPlan(AttachmentsD-1,D-2,D-3),asapprovedbytheDepartment,andincompliancewiththisAgreement.a.SHSP-fundedprojectsmustassiststate,local,tribal,andterritorialeffortstobuild,sustain,anddeliverthecapabilitiesnecessarytoprevent,preparefor,protectagainst,andrespondtoactsofterrorism.b.UASI-fundedprojectsmustassisthigh-threat,high-densityUrbanAreaeffortstobuild,sustain,anddeliverthecapabilitiesnecessarytoprevent,preparefor,protectagainst,andrespondtoactsofterrorism,c.OPSG-fundedprojectsmustsupportenhancedcooperationandcoordinationamongCustomsandBorderProtection,UnitedStatesBorderPatrol,andfederal,state,local,tribal,andterritoriallawenforcementagenciestosuppodjointeffodstosecuretheUnitedStates'bordersalongroutesofingresslegresstoandfrominternationalborders,toincludetravelcorridorsinstatesborderingMexicoandCanada,aswellasstatesandterritorieswithinternationalwaterborders.State,local,tribal,andterritoriallawenforcementagenciesutilizetheirinherentlawenforcementauthoritiestosupportthebordersecuritymissionanddonotreceiveanyadditionalauthorityasaresultofparticipationinOPSG.d.Stateagencies,includinglawenforcement,mustcomplywithRCW43.17.425andmaynotuseagencyfunds(includingthisgrant),facilities,property,equipment,orpersonnel,toinvestigate,enforce,cooperatewith,orassistintheinvestigationorenforcementofanyfederalregistrationorsurveillanceprogramsoranyotherlaws,rules,orpoliciesthattargetWashingtonresidentssolelyonthebasisofrace,religion,immigration,orcitizenshipstatus,ornationalorethnicorigin,exceptasprovidedinRCW43.17.425(3).2.TheBudget(AttachmentE)mayincludethefollowingcapsandthresholds:a.IffundsareallottedforManagementandAdministration(M&A),suchexpendituresmustberelatedtoadministrationofthegrantThemaximumpercentageoftheGrantAgreementAmountthatmaybeusedforM&AcostswhenallocatedunderthisAgreementshallnotexceedfivepercent(5%)butmaybeless,b.Atleastthirtypercent(30%)ofthecombinedHSGPawardallocatedunderSHSPandUASImustbededicatedtolawenforcementten·orismpreventionactivities(LETPA).Tomeetthisrequirement,theSubrecipienthasagreed,ataminimum,tomeettheLETPApercentageindicatedintheBudget.IftheSubrecipientanticipatesspendinglessthantheindicatedamount,abudgetamendmentisrequired.c.ThemaximumpercentageoftheGrantAgreementAmountthatmaybeusedforpersonnelexpensesunderthisAgreementisidentifiedintheBudget,iftheSubrecipientanticipatesspendingmoreonpersonnelcosts,anamendmentisrequired.Additionalapprovalstepsmayalsoberequiredbeforethepersonnelpercentagecanbeincreased.3.IffundingisallocatedtoaFusionCenterinvestment,theSubrecipientmustensureallFusionCenteranalyticalpersonneldemonstratequalificationsthatmeetorexceedcompetenciesidentifiedintheCommonCompetenciesforstate,local,andtribalintelligenceanalysts,whichoutlinestheminimumDHS-FEMA-HSGP-SHSP-FY22Page9of44KittitasCounty,E23-116
