iii.Enterinto,extend,orrenewcontractswithentitiesthatusecoveredtelecommunicationsequipmentorservicesasasubstantialoressentialcomponentofanysystem,orascriticaltechnologyaspartofanysystem.Thisprohibitionregardingcertaintelecommunicationsandvideosurveillanceservicesorequipmentismandatedbysection889oftheJohnS.McCaínNationalDefenseAuthorizationActforFiscalYear2019(FY2019NDAA),Pub.L.No.11&232(2018).RecipientsandsubrecipientsmayuseDHS/FEMAgrantfundingtoprocurereplacementequipmentandservicesimpactedbythisprohibition,providedthecostsareotherwiseconsistentwiththerequirementsoftheManualandapplicableNOFO.Persubsections889(f)(2)-(3)oftheFY2019NDAA,and2CFR200.216,coveredtelecommunicationsequipmentorservicesmeans:iv.TelecommunicationsequipmentproducedbyHuaweiTechnologiesCompanyorZTECorporation(oranysubsidiaryoraffiliateofsuchentities);v.Forthepurposeofpublicsafety,securityofgovernmentfacilities,physicalsecuritysurveillanceofcriticalinfrastructure,andothernationalsecuritypurposes,videosurveillanceandtelecommunicationsequipmentproducedbyHyteraCommunicationsCorporation,HangzhouHikvisionDigitalTechnologyCompany,orDahuaTechnologyCompany(oranysubsidiaryoraffiliateofsuchentities),vi.Telecommunicationsorvideosurveillanceservicesprovidedbysuchentitiesorusingsuchequipment;orvii.TelecommunicationsorvideosurveillanceequipmentorservicesproducedorprovidedbyanentitythattheSecretaryofDefense,inconsultationwiththeDirectorofNationalIntelligenceortheDirectoroftheFederalBureauofInvestigation,reasonablybelievestobeanentityownedorcontrolledby,orotherwiseconnectedto,thegovernmentofacoveredforeigncountry.g.TheSubrecipientmustpassthroughequipmentandsupplymanagementrequirementsthatmeetorexceedtherequirementsoutlinedabovetoanynon-federalentitytowhichtheSubrecipientmakesasubawardunderthisAgreement.5.ENVlRONMENTALANDHISTORICALPRESERVATIONa.TheSubrecipientshallensurefullcompliancewiththeDHS/FEMAEnvironmentalPlanningandHistoricPreservation(EHP)program.EHPprograminformationcanbefoundathttps://www.fema.gov/qrants/guidance-toolslenvironmental-historicallofwhichareincorporatedinandmadeapartofthisAgreement.b.Projectsthathavehistoricalimpactsorthepotentialtoimpacttheenvironment,including,butnotlimitedto,constructionofcommunicationtowers;modificationorrenovationofexistingbuildings,structuresandfacilities;ornewconstructionincludingreplacementoffacilities,mustparticipateintheDHS/FEMAEHPreviewprocesspriortoinitiation.Modificationofexistingbuildings,includingminimallyinvasiveimprovementssuchasattachingmonitorstointeriorwalls,andtrainingorexercisesoccurringoutsideinareasnotconsideredpreviouslydisturbed,alsorequireaDHS/FEMAEHPreviewbeforeprojectinitiation.c.TheEHPreviewprocessinvolvesthesubmissionofadetailedprojectdescriptionthatincludestheentirescopeofwork,includinganyalternativesthatmaybeunderconsideration,alongwithsupportingdocumentationsoFEMAmaydeterminewhethertheproposedprojecthasthepotentialtoimpactenvironmentalresourcesand/orhistoricpropedies.d.TheSubrecipientagreesthattoreceiveanyfederalpreparednessfunding,allEHPcompliancerequirementsoutlinedinapplicableguidancemustbemet.TheEHPreviewprocessmustbecompletedandFEMAapprovalreceivedbytheSubrecipientbeforeanyworkisstartedforwhichreimbursementwillbelaterrequested.ExpendituresforDHS-FEMA-EMPG-FY22Page7of39KittitasCounty,E23-184
