mental,orphysicalhandicap.Thisrequirementdoesnotapply,however,toareligiouscorporation,association,educationalinstitutionorsocietywithrespecttotheemploymentofindividualsofapadicularreligiontopelformworkconnectedwiththecarryingonbysuchcorporation,association,educationalinstitutionorsocietyofitsactivities.b.TheSubrecipientshalltakeactiontoensurethatemployeesareemployedandtreatedduringemploymentwithoutdiscriminationbecauseoftheirrace,color,sex,sexualorientationreligion,nationalorigin,creed,maritalstatus,age,Vietnameraordisabledveteransstatus,orthepresenceofanysensory,mental,orphysicalhandicap.Suchactionshallinclude,butnotbelimitedto,thefollowing:Employment,upgrading,demotion,ortransfer,recruitmentorrecruitmentselectionfortraining,includingapprenticeshipsandvolunteers.A.18NOTICESTheSubrecipientshallcomplywithallpublicnoticesornoticestoindividualsrequiredbyapplicablelocal,stateandfederallawsandregulationsandshallmaintainarecordofthiscompliance.A.19OCCUPATIONALSAFETYlHEALTHACTandWASHINGTONINDUSTRIALSAFETYlHEALTHACT(OSHA/WISHA)TheSubrecipientrepresentsandwarrantsthatitsworkplacedoesnoworwillmeetallapplicablefederalandstatesafetyandhealthregulationsthatareineffectduringtheSubrecipient'sperformanceunderthisAgreement.Totheextentallowedbylaw,theSubrecipientfurtheragreestoindemnifyandholdharmlesstheDepadmentanditsemployeesandagentsfromallliability,damagesandcostsofanynature,including,butnotlimitedto,costsofsuitsandattorneys'feesassessedagainsttheDepartment,asaresultofthefailureoftheSubrecipienttosocomply.A.20OWNERSHIPOFPROJECT/CAPlTALFACILITlESTheDepartmentmakesnoclaimtoanycapitalfacilitiesorrealpropertyimprovedorconstructedwithfundsunderthisAgreement,andbythissubawardoffundsdoesnotandwillnotacquireanyownershipinterestortitletosuchpropertyoftheSubrecipient.TheSubrecipientshallassumeallliabilitiesandresponsibilitiesarisingfromtheownershipandoperationoftheprojectandagreestoindemnifyandholdtheDepartment,thestateofWashington,andtheUnitedStatesgovemmentharmlessfromanyandallcausesofactionarisingfromtheownershipandoperationoftheproject.A.21POLITICALACTIVITYNoportionofthefundsprovidedhereinshallbeusedforanypadisanpoliticalactivityortofurthertheelectionordefeatofanycandidateforpublicofficeorinfluencetheapprovalordefeatofanyballotissue.A.22PROHIBITIONAGAINSTPAYMENTOFBONUSORCOMMISSIONTheassistanceprovidedunderthisAgreementshallnotbeusedinpaymentofanybonusorcommissionforthepurposeofobtainingapprovaloftheapplicationforsuchassistanceoranyotherapprovalorconcurrenceunderthisAgreementprovided,however,thatreasonablefeesorbonafidetechnicalconsultant,managerial,orothersuchservices,otherthanactualsolicitation,arenotherebyprohibitedifotherwiseeligibleasprojectcosts.A.23PUBLICITYTheSubrecipientagreestosubmittotheDepadmentpriortoissuancealladvertisingandpublicitymattersrelatingtothisAgreementwhereintheDepartment'snameismentioned,orlanguageusedfromwhichtheconnectionoftheDepartment'snamemay,intheDepartment'sjudgment,beinferredorimplied.TheSubrecipientagreesnottopublishorusesuchadvertisingandpublicitymatterswithoutthepriorwrittenconsentoftheDepartment.TheSubrecipientmaycopyrightoriginalworkitdevelopsinthecourseoforunderthisAgreement,however,pursuantto2CFRPart200.315,FEMAreservesaroyalty-free,nonexclusive,andirrevocablelicensetoreproduce,publishorotherwiseuse,andtoauthorizeotherstousetheworkforgovemmentpurposes.PublicationresultingfromworkperformedunderthisAgreementshallincludeanacknowledgementofFEMA'sfinancialsupport,bytheAssistanceListingsNumber(formerlyCFDANumber),andastatementthatthepublicationdoesnotconstituteanendorsementbyFEMAorreflectFEMA'sviews.A.24RECAPTUREPROVISIONIntheeventtheSubrecipientfailstoexpendfundsunderthisAgreementinaccordancewithapplicablefederal,state,andlocallaws,regulations,and/ortheprovisionsoftheAgreement,theDepartmentreservestherighttorecapturefundsinanamountequivalenttotheextentofnoncompliance.SuchrightDHS-FEMA-EMPG-FY22Page17of39KittitasCounty,E23-184
