KITTITAS COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS <br />2023 STUDY SESSION STAFF REPORT <br />STUDY SESSION DATE: February 13, 2023 <br />TOPIC: Public Facility Districts in the State of Washington <br />ACTION REQUESTED: Direct Staff <br />LEAD STAFF: <br />Mark R. Cook, Amy Cziske, Mike Hougardy, Bryan Elliott, Brian Carlson <br />RECOMMENDATION: <br />Direct staff prepare a proposal for Board consideration. <br />BRIEFING SUMMARY: <br />• Public Facility Districts are authorized in state law at Revised Code of <br />Washington 36.100 (EXHIBIT 1). <br />• The district is created upon adoption of a resolution by the county legislative <br />authority. <br />• No taxing authority may be assessed without majority vote within the district. <br />• County may have more than one district. <br />• Governance board is required. <br />• Independent financial feasibility review is required prior to formulation. <br />• District funding authorized: Ad valorem property tax, excise tax, general <br />obligation bonds, revenue bonds, tax on admissions and tax on vehicle parking <br />charges. <br />BACKGROUND: <br />An Upper County Not for Profit (501(c) 3) "UKC Community Recreation Center <br />Alliance (UKCCRCA), formed in 2021, is advancing a proposal to develop, design and <br />build an upper county recreation center on 12 acres of City of Cle Elum land (EXHIBIT <br />2). Numerous project stakeholders have joined the effort, and the UKCCRCA is focused <br />on building additional support to ensure the success of the project. There is currently no <br />identified funding mechanism allowing the project team access to federal grant funding <br />opportunities. <br />DISCUSSION: <br />Prior to establishing a Public Facility District in the county, an independent financial <br />feasibility review is required. The review (RCW 36.100.025) must be conducted by the <br />department of commerce through the municipal research and services center - MRSC <br />(RCW 43.110.030) or under a contract with another entity under the authority of RCW <br />43.110.080. The county may utilize consulting services (43.110.080) meeting the <br />obligation defined at 36.100.025. <br />Page 1 of 4 <br />Public Works "Work Session Staff Report", 2023 <br />
