7.1.11IndemnificationbySubrecipient'sContractors.ForpurposesofthisSection7.1.11-IndemnificationbySubrecipient'sContractorstheterm"contractor"meansactorsdownstreamoftheSubrecipientwhetheritbeacontractor,asubcontractor,ordownstreamsubrecipientoftheSubrecipient.TheSubrecipientshalltakeallreasonablestepstocauseitscontractor(s)toindemnify,defend,saveandholdharmlesstheStateofWashingtonanditsofficers,employeesandagents("Indemnitee")fromandagainstanyandallclaims,actions,liabilities,damages,losses,orexpenses(includingattomeys'fees)arisingfromatoricaused,orallegedtobecaused,inwholeorinpart,bythenegligentorwillfulactsoromissionsofSubrecipient'scontractororanyoftheofficers,agents,employeesorsubcontractorsofthecontractor("Claims").ItisthespecificintentionofthePartiesthattheIndemniteeshall,inallinstances,exceptforClaimsarisingsolelyfromthenegligentorwillfulactsoromissionsoftheIndemnitee,beindemnifiedbythecontractorfromandagainstanyandallClaims.7.2ResponsibilityofMarineLawEnforcementProgram(MLE):7.2.1MLEshallpaySubrecipientasdescribedinSections8-ConditionstoDisbursementandSection9-ReimbursementandPaymentTerms.SECTION8:CONDITIONSTODISBURSEMENT8.1Eligibleprojectexpensesincludeonlythoseitemsfromthelistbelowthatareinyourapprovedprojectbudget:8.1.1GrantfundsmaybeusedonlyforactivitiesunderWAC352-65-040,thetenelementsnecessarytoaccomplishtheRecreationalBoatingSafety(RBS)mission.8.1.2RBSsalariestoincludetime,salaries,benefitsandwagesforofficersordeputieswhopossessaWashingtonStatePeaceOfficersCertification,arefullycommissionedtoenforcethelawsofWashingtonstateandwhohavecompletedanRBScourseacceptabletoStateParks(BMLEorequal).8.1.3Time,salaries,benefitsandwagesforofficersordeputieswhopossessaWashingtonStatePeaceOfficersCedification,arefullycommissionedtoenforcethelawsofWashingtonstate,andwhohavenotcompletedaBMLEcourseisacceptableONLYwhenworkingwithanRBStrainedofficerANDwhentheagencyhasawritten"two-officerpolicyforofficersonmarinepatrolforthepurposeofofficersafety.8.1.4ProvidinginstructorsfortheAdventuresinBoatingcoursethatqualifiesgraduatesfortherequiredmandatoryboatereducationcard.Costmayincludeclassroomsupplies,lightrefreshments,othergoods,andsenticesnecessarytopromoteandteachclasses,andofficersalaries,benefits,andwages.OfficersalarieswillonlybereimbursedforthoseofficerswhohavesuccessfullycompletedStateParksAdventuresinBoatingInstructorTrainingClassandarelistedonourfiles.8.1.5RBStrainingasoutlinedintheAllowableCostsandExpendituresforStateVesselRegistrationFeesandFederalAssistanceGrants(Attachment"C")8.1.6RBSEquipmentasoutlinedintheAllowableCostsandExpendituresforStateVesselRegistrationFeesandFederalAssistanceGrants(Attachment"C").Anyequipmentexpendituresovertwothousandtwohundredandfiftydollars($2,250.00)mustreceiveauthorizationfromstateparkspriortopurchase.MLE123-407SubrecipientAgreement-BoatingProgram(FFAGrantAward)Page6of35
