SECTION18:LIABILITYINSURANCE18.1LIABILITYINSURANCE-lfrequiredinthespecialtermsandconditionssubrecipientshallobtainandkeepinforceduringthetermofthisAgreement,acombinedsinglelimitbodilyinjuryandpropedydamageinsurancepolicyintheminimumamountof$1,000,000.00namingWashingtonStateParksCommissionasanadditionalinsuredagainstanyliabilityarisingoutofSubrecipient'soritsagents,employees,orassigns.SubrecipientshallprovidetoCommission,acertificateevidencingsuchinsurancecoverageandshallprovide30dayswrittennoticepriortoanychangesintheamountorcancellationofsaidpolicy.•Subrecipientshallbuyandmaintainpropertyinsurancecoveringallrealpropertyandfixtures,equipment,andtenantimprovementsandbetterments.Suchinsuranceshallbewrittenonanall-risk'sbasisand,ataminimum,covertheperilsinsuredunderISOspecialcausesoflossFormCP1030,andcoverthefullreplacementcostofthepropertyinsured.Suchinsurancemayhavecommerciallyreasonabledeductibles.•Anycoinsurancerequirementinthepolicyshallbewaived.•Stateshallbeincludedasaninsuredandalosspayeeunderthepropertyinsurancepolicy.18.2AUTOMOBILEINSURANCE--Subrecipientshallmaintainbusinessautoliabilityand,ifnecessary,commercialumbrellaliabilityinsurancewithalimitnotlessthan$1,000,000.00peraccident.Suchinsuranceshallcoverliabilityarisingoutof"AnyAuto."BusinessautocoverageshallbewrittenonISOformCA0001,orsubstituteliabilityformprovidingequivalentcoverage.Ifnecessary,thepolicyshallbeendorsedtoprovidecontractualliabilitycoverage.SubrecipientwaivesallrightsagainstStatefortherecoveryofdamagestotheextenttheyarecoveredbybusinessautoliabilityorcommercialumbrellaliabilityinsurance.18.3INDUSTRIALINSURANCECOVERAGE--SubrecipientshallprovideorpurchaseindustrialinsurancecoverageforthemselvestheiremployeesasrequiredbyLaborandIndustriespriortopelformingworkunderthisAgreement.CommissionwillnotberesponsibleforpaymentofindustrialpremiumsorforanyotherclaimorbenefitforSubrecipient,oranysubcontractororemployeeofSubrecipient,whichmightariseundertheindustrialinsurancelawsduringtheperformanceofdutiesandservicesunderthisagreement.Subrecipient,itsemployeesandagentsperformingunderthiscontract,arenotemployeesofCommission.18.4CERTIFICATEOFINSURANCE/NAMINGWASHINGTONSTATEASADDITIONALINSURED:AcurrentCertificateofInsurancemustbesubmittedwiththegrantapplicationform.ThecertificatemustnameWashingtonStateParksandRecreationCommissionasanadditionalinsured,andtheCertificateHolderandcontainaprovisionthattheinsurancewillnotbecanceledforanyreasonexceptafterthirty(30)dayswrittennotice.FacilitiesmustbeinsuredbycarrierslicensedinoreligibletodobusinessinWashington,andmustmaintainapplicableCommercialGeneralLiability,AutomobileLiability,andWorker'sCompensationcoverage.GovernmententitieswillneedtoincludealetterfromtheirChiefFinancialOfficerstatingiftheyareself-insuredorprovideacertificateofinsuranceasstatedbelow."MLE123-407SubrecipientAgreement-BoatingProgram(FFAGrantAward)Page17of35
