andshallincludethesamerequirementsasthoseimposedintheoriginalgrant.Anycashorin-kindmatchpaidwhentheequipmentwasoriginallypurchasedwillbeforfeitedintotal.•Iftheequipmentcannotbetransferredtoanotherlawenforcementagencywithastateapprovedmarinelawenforcementprogram,itmustbesoldatthediscretionoftheMLE,andtheSubrecipientshallpayMLEtheproceedsofthesaleorthefairmarketvalueoftheequipment,whicheveristhegreatest.12.6.1EquipmentBreakdownIntheeventanequipmentbreakdownoccursduringthegrantperiod,SubrecipientshallnotifyMLEwithinten(10)workingdaysofbreakdown.Theequipmentmustberepairedandfullyoperationalwithinthirty(30)workingdaysafterthebreakdownwherethebreakdowncanberemediedwithnormalexpectedrepairsforonethousanddollars($1,000.00)orless.Forrepairsgreaterthanonethousanddollars($1,000.00)theequipmentmustbefullyoperationalwithinsixty(60)daysafterthebreakdown.AwrittenreportforallbreakdownsmustbesubmittedviaemailtoMLEwithintwo(2)weeksofthebreakdowndescribingtheproblem(s),repair(s),andthecost(s).AfailuretonotifyMLEofanequipmentbreakdownandplanforrepairsmayresultinthewithholdingofgrantfunds.12.7AccidentReportSubrecipientsorSubrecipient'sstaffinvolvedinanaccidentmustremainatthesœneandassistanyothervesselorpersoninvolved,ifpossible,withoutendangeringtheirsafety,theirownvessel,orthepeopleaboard.SECTION13:OWNERSHIPOFWORKPRODUCT13.1AsusedinthisSection13-OwnershipofWorkProductandelsewhereinthisAgreement,thefollowingtermshavethemeaningssetforthbelow:13.1.1ProjectOwnership.MLEacknowledgesandagreesthattheProjectistheexclusivepropertyoftheSubrecipient.MLEisneitherresponsiblenorliableinanymannerfortheconstruction,operation,ormaintenanceoftheProject.13.1.2SpecialSurvivorshipNote:Ownershipisnotabsolute.Regardlessofagreement'sexpiration,anythingtangible,intangible,orintellectualpropertythatwaspurchasedorcreatedfromfederalfundsorfundedwithfederalfundsmaintainsfederalandstateMLEentanglements,requirements,orconditions(conditionalownership),unlessluntilreleasedbyMLEorfederalgovernmentinwriting.Whileotherconditionsmayapply,typicallyareleasewouldoccurupontheMLE,orfederalgovernmentbeingcompletelysatisfiedthattheiteminquestionhasreachedtheendofitsusefullifewhichisusuallyadollarvalue.DeterminationofvalueissolelyatthediscretionoftheMLEorfederalgovemment.Shouldprofessionalappraisalservicesbeneededtodeterminevalue,thesecostsshallbebornebytheSubrecipient.SelectionofanappraisalservicesfirmissubjecttothewrittenapprovaloftheMLEorfederalgovernment.MLE123-407SubrecipientAgreement-BoatingProgram(FFAGrantAward)Page14of35
