12.4SpecialSurvivorshipNote:Ownemhipisnotabsolute.Regardlessofagreement'sexpiration,anythingtangible,intangible,orintellectualpropertythatwaspurchasedorcreatedfromfederalfundsorfundedwithfederalfundsmaintainsfederalandstateMLEentanglements,requirements,orconditions(conditionalownership)unlessluntilreleasedbytheMLEorfederalgovernmentinwriting.Whileotherconditionsmayapply,typicallyareleasewouldoccurupontheMLE,orfederalgovemmentbeingcompletelysatisfiedthattheiteminquestionhasreachedtheendofitsusefullifewhichisusuallyadollarvalue.DeterminationofvalueissolelyatthediscretionoftheMLEorfederalgovernment.Shouldprofessionalappraisalservicesbeneededtodeterminevalue,thesecostsshallbebornebytheSubrecipient.SelectionofanappraisalservicesfirmissubjecttothewrittenapprovaloftheMLEorfederalgovernment.12.5UseandMaintenance.TheSubrecipientshalloperateandmaintaintheequipment,purchased,constructed,installed,renovated,operated,repaired,ormaintainedwithMLEgrantfundstofunctionasintendedforthefullperiodoftheirusefullifeandinamannerthatprovidesadequatesentice,promotesuse,andprotectspublichealth.Suchconditionsinclude:12.5.1SubrecipientshalloperateandmaintaingrantfundedequipmentinaccordancewithallapplicableFederal,State,andlocallaws,orders,regulationsandpermits.12.5.2Operationshallincludehavingtrainedpersonnelavailabletofacilitateoperationoftheequipmentandascheduleformaintenance.12.5.3LawEnforcementvesselsshallbeoperatedbytrainedpersonnelwithavalidStateofWashingtonBoaterEducationCardorequivalentandbeagraduateofstateparksBasicMarineLawEnforcementAcademyorequivalent.12.5.4LawEnforcementvesselsshallbeequippedwithallfederallyrequiredsafetyequipmentandprovideandensureappropriatepersonalflotationdevicesarewornatalltimeswhenonthevesselordock.12.5.5Alllawenforcementvesselsshallhavearoutinescheduleformaintenance.12.5.6Asaconditionofreceivingthegrantfunds,Subrecipientshallactivelymaintainthevesselforthefulldesignlifeoftheequipmentprovidedfromthisgrant.12.5.7Subrecipientshallberesponsibleforalloperation,maintenance,andrepairofallvesselsandequipmentprovidedfromthisgrant.12.6EquipmentReplacement.WhenoriginalorreplacementequipmentacquiredunderthisawardisnolongerneededortheSubrecipientisnolongerabletosupporttheRBSmissionandthedispositionoccursduringthegrantperiod,dispositionoftheequipmentshallbemadeasfollows:•Theequipmentmaybetransferredatnocosttoanotherlawenforcementagencywithastateparksapprovedmarinelawenforcementprogram(e.g.,cityorcountylawenforcementagency)ifsuchequipmentwillremaininuseandbededicatedtotheMLEprogram.TheconditionsforsuchtransfershallbestipulatedbytheMLEMLE123-407SubrecipientAgreement-BoatingProgram(FFAGrantAward)Page13of35
