SECTION12:EQUIPMENT:OWNERSHIP,MAINTENANCE,USEFULLIFE&DISPOSAL12.1OwnershipOfEquipment.Exceptasotherwiseprovidedherein,Subrecipientshallretainownershipofequipmentpurchasedpursuanttothetermsofthegrant.Subrecipientmaynot,duringthetermofthegrant,transferorconveyitsownershipinterestintheequipment.Subrecipientshallnotatanytimeduringthetermofthegrantconvertanyfacilityequipmentwhichwasacquiredpursuanttothegranttoauseotherthanthoseforwhichtheassistancewasoriginallyapproved.EquipmentpurchasedwithRecreationalBoatingSafetyActfundsshallbeusedonlyforthepurposeforwhichitwaspurchasedandnootherpurpose,whetherornottheSubrecipientcontinuestobesupportedbyRecreationalBoatingSafetyActgrantfunds.Observed/reportedincidentsofunauthorizeduseofMLEequipmentshallbeaddressedbythefollowing:1)Anyobserved/reportedincidentofunauthorizeduseofMLEfundedvesselswillbefollowed-upbyMLEcommunicationwiththeSubrecipient.MLEmayconductsitevisitsorcontactareaboatersforsupplementalinformationasnecessary.2)InthoseinstanceswheretheMLEdeterminesthatanunauthorizeduseofaMLEfundedvesselhasoccurred,theMLEwillprovidewrittennotificationtotheoperatorofitsdeterminationwithawarningthatcontinuedmisuseorabuseofMLE-fundedvesselsandequipmentmayresultin:a)theremovalofmisusedequipmentfromthefacility,and/orb)anassessmentagainsttheoperatorforreimbursementofthefederalcontributionagainstthecurrentmarketvalueofthevessel.12.2Title.TitletoequipmentpurchasedunderthisAgreementshallvestintheSubrecipient.IftheSubrecipientdeterminesthatitcannotusetheequipmentforthestatedgrantpurposesatanypointpriortotheendoftheequipment'susefullife,butaftertheendofthisawardperiodandanyextensionsthereof,theSubrecipientshallinformMLEinwritingwithin30daysofsuchdetermination.SuchequipmentshallbetransferredbytheSubrecipienttoathirdpartyapprovedbyMLEforuseforgrantpurposesinaccordancewithapplicableprovisionsofstateandfederallaw.ShouldtheequipmentnotbetransferredtoanotherstateparksRBSapprovedlawenforcementagencyinaccordancewiththisprovision,theequipmentshalleitherbereturnedtoMLEforuseforgrantpurposes,oritshallbedisposedinaccordancewith50CFRPait85;and2CFRPart200.12.3UsefulLife.Beyondtheacquisitiongrantperiodofperformanceandthroughoutthedurationoftheequipment'susefullife,theequipmentmustcontinuetobeusedintheprogramorprojectforwhichitwasacquired,asRecreationalBoatingSafetyActProgram.Whennolongerneededfortheoriginalprogramorproject,equipmentmaybeusedinotheractivitiesinthefollowingorderofpriority:a.ActivitiessupportedunderaFederalawardfromtheFederalawardingagencywhichfundedtheoriginalprogramorproject;thenb.ActivitiesunderFederalawardsfromotherFederalawardingagencies;thenc.AnyactivitiesconsistentwiththeadministrationoftheWashingtonStateParksandRecreationCommission.MLE123-407SubrecipientAgreement-BoatingProgram(FFAGrantAward)Page12of35
