submittedforreimbursementduringthequarterwhichthecostsareincurred.Thecostsalsomustbeallowableandwelldocumented,inconformancewithspecificfederalrequirements(50CFRPart85;and2CFRPart200asapplicableandasadoptedinregulationby2CFR1402.100.9.5Payments.AftertheSubrecipientawardsthecontractfortheProject,andactivitiescommence,MLEshall,uponreceiptoftheSubrecipient'srequestforreimbursementandappropriatedocumentationallinformandsubstancesatisfactorytoMLE,disbursefundstotheSubrecipientinaccordancewithSection8-ConditionstoDisbursement.Subrecipientmayrequestreimbursementsnolessthanonaqualterlybasisandduringthequalterforwhichtheexpenditureshavebeenincurredforprojectexpenses.ReimbursementshalltakeplaceafterSubrecipientsubmitsaproperlycompletedReimbursementRequestForm(providedbyMLE),alongwithrequiredsupportingdocumentation.RequestsshallonlybeallowedwhenrequestedontheproperformsprovidedbyMLE,referencethisagreementnumber,andaccompaniedwithappropriatesupportingdocumentation.Subrecipientshallbereimbursedfortheactualprojectcostsincurred,uptothetotalreimbursementamountdefinedaboveaslongasgrantfundsremainavailable.Accountingproceduresmustprovideforaccurateandtimelyrecordingofreceiptoffundsbysource,expendituresmadefromsuchfunds,andofunexpendedbalances.Controlsmustbeestablishedwhichareadequatetoensurethatexpendituresareforallowablepurposesandthatdocumentationisreadilyavailabletoverifythatsuchchargesareaccurate.Theburdenofprooflieswiththesubrecipienttoprovideclearinformationastotheexpenseandformofpayment.9.6CostOverruns.CostoverrunsaretheresponsibilityofSubrecipientandmustbebornebySubrecipient.9.7Overpayment.IntheeventthattheaggregateamountofMLE'sinterimprogresspaymentstotheSubrecipientexceedstheallowablereimbursablecostsoftheSubrecipientfortheProject,theSubrecipientagreestorefundtoMLEtheamountpaidinexcessofsuchallowableexpenseswithinthirty(30)daysofSeptember30,2023.9.8OffsetorReduction.TheSubrecipientagreesthatpayment(s)madebyMLEunderthisAgreementshallbesubjecttooffsetorreductionforanyamountspreviouslypaidhereunderthatarefoundbyMLEnottoconstituteallowablecostsunderthisAgreementbasedontheresultsofanauditexamination.Ifsuchdisallowedamountexceedsthepayment(s),theSubrecipientshallpayMLEtheamountofsuchexcesswithin30daysafterwrittennotiœofdisallowedcostsisprovidedbyMLE.9.8.1EntertainmentCosts.Inaccordancewith2CFR200,thecostofamusement,diversion,socialactivities,ceremonials,andcostsrelatingthereto,suchasmeals,lodging,rentals,transportation,gratuities,andalcoholicbeveragesarenotallowableexpenses.9.8.2PriorCosts.MLEwillnotreimburseSubrecipientforanycostsincurredpriortotheeffectivedateofthisagreementOctober1,2022.MLE123-407SubrecipientAgreement-BoatingProgram(FFAGrantAward)Page10of35
