i, Procure or obtain any equipment, system, or seruice that uses covered <br />telecommunications equipment or serulces as a substantial or essential <br />component of any sysilem, or as critical technology of any system; <br />ii. Enter into. extend, or reneu, a conhacl to procure or obtain any equipment, <br />systetn, orservice that uses covered telecommunications equipment oisirvices <br />as a substantlal or essential componenl of any system, or as irtticaltechnology <br />of any system; or <br />iia. Enter into, extend, or renew contracts with entities that use covered <br />telecommunications equipment or seryices as a substantial or essential <br />component of any system, or as critical technology as part of any system. <br />This prohibition regarding certain telecommunications and video surveillance services or <br />equipment is mandated by sectbn 889 of lFe- John S. McCatn National Oefense <br />Authoization Act for F.i*at Year 20i9-(Fy _2019 NDAA), pub. L, No. it&292 (201a). <br />Recipients and subrecipients may use DHS/FEIVIA grantiunding to procure reptaiement <br />equipment and servioas impacted by this prdribition, provided the costs are otherwise <br />consistentwilh the requirements of the Manual ard apiticaUle NOFO. <br />Per section 8q9OeF(3) of the FY 2019 NDAA, and 2 cFR 200.216, covered <br />telecommunications equipment or seruioes means: <br />i. TelecommunicationsequipmentproducedbyHuawelTechnologiesCompanyor <br />ZTE Corporation, (or any subsidiary or afiiliate of sudr entities); <br />ii. For the puryos.F of public safe$, searrity of government facililbs, physical <br />securi$ surueillance of critical infastrudure, and other national 'se"u,ity <br />purposes, video surveillance and telecommunications equipment produced by <br />ly{era Communications. Corporatlon, Hangzhor Hikvisi6n'Digital'Technology <br />Co.mpany, or Dahua Tedrnology Company (or any subsidiary oi affliate of suih <br />entities); <br />iii. Telecommunications or video surveillance seMces provlded by such enflties or <br />uslng such equipment; or <br />iv. Telecommunlcations or Mdeo surveillance equipment or services prcdued or <br />provided by an entity that the Secretary of Defense, in consultration with the <br />Director of National lntelligence or the Diredor of the Federal Bureau of <br />Investigation, reasonably. belicvcs to be an entity owned or conbo1ed by, or <br />othenrlse connec{ed to, the government of a covered foreign country.g. Th9 Subrecipient must pass tlrough equipment and supply management requirements <br />thal meet or exceed the requirements outlined above to any non-federalentity to wtrich <br />the Subrecipient makes a subaward underthisAgreement <br />5. ENVIRONI'ENTALANDHISTORICALPRESERVATIOI{a. The Subredpient shall engure full compllance with the DHS/FEMA Environmentd <br />Planning and Historic Preservation (EHP) program. EHP program information can be <br />found at https:/&rrvw,fgma.gov/orantgquidancetools/envirohmental-hisg,Iig ail of which <br />are incorporated in and made a part of this Agreement. <br />b- Projects that have historical impact-s or the potential to impad the environment, including, <br />but not llmlted to, construction of commr,nication toweis; modification or renovation ii <br />9n:!!19 buildings, structures and facilities; or ntr construction including replacement of <br />facilities, . must participate in the DHS/FEMA EHP review prooess p'rior'to initiation. <br />Modlfication of existing buildings, indudiry minimatly invasive improvements such as <br />attaching monitors to lnterlor wdls, and training or exercises occuning outside in areas <br />not considered previousfi dlsturbed, also require a DHS/FEMA EHP refre$/ before proj€d <br />initiatlon. <br />c.
