collectionofLatecomerChargespursuanttothisAgreement,andthisAgreementshallhavenofurtherforceoreffectF.UNAUTHORIZEDCOLLECTIONWheneveranyconnectionismadeintotheFacilitleswhichisriotauthorizedbytheCity,theCityshallhavetheabsoluteauthoritytoremoveorcausetoberemovedsuchunauthorized-connectionsandallconnectinglinesorpipes,locatedintheright-of-wayoronCityproperty.TheCityshallincurnoliabilityforanydamagetoanypersonorpropertyresultingfromremovaloftheunauthorizedconnection.G.MISCELLANEOUS1.ThisAgreementshallbecomeoperativeuponitsbelngrecordedwiththeAuditoroftheCountyinwhichanyofthebenefitedlandsaresituated,attheexpenseoftheOwner,andshallremaininfullforcearideffectforaperiodoftwentyyearsafterthedateofsuchrecording,oruntiltheOwner,ortheirsuccessorsorassigns,shallhavebeenfullyreimbursedasaforesaid,whichevereventoccursearlier,provided,thatintheeventtheadditionsshownonFigure1&2oranyportionsthereofshall,duringthetermofthisAgreement,berendereduselessbytheredesignorreconstructionintheabsolutejudgmentoftheCityEngineer,thentheCity'sobligationtocollectfortheOwnerofthetappingorconnectionchargesprovidedpursuanttothisAgreementshallcease.2.AllnoticesunderthisAgreementshallbewriting,andshallbedeliveredormailedbycertifiedmail,returnreceiptrequested,andshallbeeffectiveasofthedateofdellvery,onthedateofreceiptasshownbythereturnrecelpt,orthreedaysafterthepostmarkdateifthereisnoreturnreceipt.Noticesshallbeaddressedtothefollowingaddressesortosuchotheraddressasapartymayspecifyinwriting:City:Owner:CityofEllensburgKittitasCounty,byandthroughKittitasCityEngineerCountySolidWaste501N.AndersonSt.PattiStacey,DirectorEllensburg,WA98926925IndustrlalWayEllensburg,WA08926OwneracknowledgesandagreesthatcommencingeverytwoyearsfromthedatethisAgreementisexecuted,theyprovidetheCitywithinformatlonregardingtheircurrent-addressandtelephonenumber.IftheOwnerfailstocomplywiththenotificationrequirementsofthissubsectionwithinsixtydaysofthespecifiedtime,thentheCitymaycollectanyreimbursementfundsowedtothepropertyownerunderthisAgreement,whichshallbedepositedinthecapitalfundoftheClty.LatecomerAgreementforReimbursement-Page5of7
