constructionthereof,andwhosubsequentlytapontoorusethesame,afairproratashareofthecostofsuchconstructlonbaseduponthesumof$88.04($101.25with15%AdministrationCost)forsewerand$50.07($57.58with15%AdministrationCost),forwaterperlinealfrontfoot;unitchargesshallbeconclusivelypresumedtobeafairproratachargeagainstthebenefitedparcel(s),inaddltiontotheamountsagreedtobecollectedbytheCityInthisparagraph,theCltyshallchargeinadditiontoitsusualandordinarychargesmadeagainstpersonsapplyingforservicefromsaidfacilltyasumequaltofifteenpercentoftheamountagreedinthisparagraphbytheCitytobecollectedforOwnerfrompersontappingontosaidfacility,whichsumshallbeusedbytheCltytodefraythecostoflabor,bookkeepingandaccountingpursuanttothetermsofthisAgreement.3..TheCityshallpaytotheOwnerthesumsagreedbyIttobecollectedpursuanttotheprovisionsoftheprecedingparagraph,within.sixty(60)daysafterreceiptbytheCityattheaddressoftheOwnerassetsforthhereinafteroratsuchotheraddressastheOwnershallprovidebyCertiftedmail,IfsaidpaymentsarereturnedtotheCityuncialmedbytheOwnerorlftheCityisunabletolocatetheowner,aftersix(6)months,theCityshallretainallsumsthenrecelvedandallfuturesumscollectedunderthisAgreement.4.Intheeventof‡heassignmentortransferoftherightsoftheOwnervoluntarily,involuntarily,orbytheoperationoflaw,theCityshallpayanybenefitsiaccruinghereunder,afternotice,tothesuccessoroftheOwnerastheCity,initssolejudgment,deemsentitledtosuchbenefits;andintheeventconflictingdemandsaremadeupontheCityforbenefitsaccruingunderthisagreement,thentheCitymayatitsoptioncommenceanactionininterpleaderjoininganypartyclaimingrightsunderthisAgreement,orotherpartieswhichtheCltybelievestobenecessaryorproperandtheCityshallbedlschargedfurtherliabilityuponpaylngthepersonorpersonswhomanycourthavingJurisdictlonofsuchinterpleaderactionshalldetermine,andinsuchactiontheCityshallbeentitledtorecoveritsreasonableattomey'sfeesandcosts,whlohfeesandcostsshallconst|tuteaIIenuponallfundsaccruedoraccruingpursuanttothisagreement.5,.TheCityagreesnottoallowanyowneroruser.ofanybenefitedproperty.asdëscribedinFigure1and2(futureservicearea)toconnectortapontosaidfacilitywithoutsuchowneroruserhavingfirstpaidtotheCityasumequaltothefairproratachargehereinabovesetforth.6.TheCityshallbeentitledtorelyontheprovlslonsofthisAgreementwithrespecttothefalrnessoftheproratachargehereinprovided,anduponthedescriptionofthebenefitedpropertiessetforthinFigure1and2(futureservicearea).7.ThetotalamounttobereimbursedtoOwnerunderthisAgreementshallnotexceed$657,301.29(the"MaximumReimbursementAmount").UponconfirmationbytheCityandtheOwnerthattheamountsremittedtotheOwnerpursuanttoparagraphareequaltotheMaximumReimbursementAmount,theCityshallceaseitsLatecomerAgreementforReimbursement-Page4of7
