thereinassertedbyanythirdperson,thattheywillguaranteetheworkmanshipandmaterialsinsaidfacilitiesforaperiodofoneyearafterdateofacceptancebytheCity,andthattheywarrantsaidextensionstobefitfortheuseforwhichtheyareIntended.2.OwnerhasfurnishedtheCitywithanltemizedwrittenstatementofallcostsincurredfortherequiredimprovements,includingallchargesincurredformaterialsandlaborthathavebeenpaidbyOwner,andOwnerwarrantstherearenoliensagainstthepropertyorimprovements.3.OwnerfurtherwarrantsthatitistheownerIntitleabsoluteoftheextensionsshowninFigure1and2,thatithasneitherpermittednorsufferedanypersonorotherentitytotapontosaidextensionspriortothedateofthisAgreement;thatthesumof$88.04($101.25with15%AdministrationCost),forsewer,and$50.07($57.58with15%AdrninistrationCost),forwater,perlinealfrontfootIsafairproratachargetobeassessedagainsttheowner(s)ofeachparcelwithinthebenefitedpremises(futureservicearea),asshownonFigure1and2,whosubsequentlytapontoorconnecttosaidfacility,andtofurtherwarrantthattherearenopersons,firmsorcorporationswhohavefiledorhavetherighttofilealienagainstsaidextensionsperprovisionsofTitle60RCW.intheeventanylienorotherclaimagainstsaidextensionsisassertedafterconveyancetotheCity,whichlienorclalmaroseonorpriortosuchconveyance,thentheOwnershalldefendandsaveharmlesstheCityfromlossonaccountthereof,andintheeventtheCityshallbeputtoanyexpenseindefenseofsuchclaimorotherwise,thentheCityshallhavealienagainstanyfundsthenorthereafterdepositedwlthitpursuanttothisAgreement.4.InconsiderationoftheconveyanceoftheFacilitiesshowninFigure1and2,theCityagreestoacceptsaidextensionsformaintenanceasapartofitsfacility,afterinspectionandtestingbytheCity.E.ASSESSIVIENTANDCOLLECTIONOFLATECOMERFEESII1.TheCityandtheOwnerdesiretoandintendbythisAgreementtoprovideforcollectionofthefairproratashareofthecostofconstructlonofsaldextensionsfromtheowner(s)ofthebenefltedpropertiesshownonFigure1and2whodidnotcontributetotheoriginalcostthereof,undertheprovisionsoftheMunlclpalWaterandSewerFacilitiesAct,Chapter35.91RCW,provided,however,thatnothingcontainedheremshallbeconstruedtoaffectorimpairinanymannertherightoftheCltytoregulatetheuseofitssaidsystemsofwhichtheFacilitlesshownonFlgure1and2shallbecomeapartunderthetermsofthisAgreement,pursuanttoprovisionsofanyResolution,orpolicynoworhereafterineffect.TheimpositionbytheCityofanysuchrequirementsshallnotbedeemedanimpairmentofthisAgreementthoughitmaybeimposedinsuchmannerastorefuseservicetoanownerofthebenefitedpropertytosecurecompliancewithsuchrequirementsofthecity.2.TheCityfurtheragreestocollectfromtheowner(s)oftherealpropertybenefitedbysaidFacilitieswhohavenotheretoforecontributedtothecostofLatecomerAgreementforReimbursement-Page3of7
