waived,modifiedordeletedexceptbyaninstrument,inwriting,signedbythepartieshereto.29.Survival:Theprovisionsofparagraphs7,9,11,13,14,15,16,17,18,19,20,21,22,23,24,28,30,31,and32shallsurvive,notwithstandingtheterminationorinvalidityofthisAgreementforanyreason.30.Nondiscrimination:30.1TheCountyisanequalopportunityemployer.30.2NondiscriminationinEmploymentIntheperformanceofthisAgreement,theContractorwillnotdiscriminateagainstanyemployeeorapplicantforemploymentonthegroundsofrace,creed,color,nationalorigin,sex,sexualorientation,maritalstatus,ageorthepresenceofanysensory,mentalorphysicalhandicap;providedthattheprohibitionagainstdiscriminationinemploymentbecauseofhandicapshallnotapplyiftheparticulardisabilitypreventstheproperperformanceoftheparticularworkerinvolved.TheContractorshallensurethatapplicantsareemployed,andthatemployeesaretreatedduringemploymentwithoutdiscriminationbecauseoftheirrace,creed,color,nationalorigin,sex,sexualorientation,maritalstatus,ageorthepresenceofanysensory,mentalorphysicalhandicap.Suchactionshallinclude,butnotbelimitedto:employment,upgrading,demotionortransfers,recruitmentorrecruitmentadvertising,layoffortermination,ratesofpayorotherformsofcompensation,andprogramsfortrainingincludingapprenticeships.TheContractorshalltakesuchactionwithrespecttothisAgreementasmayberequiredtoensurefullcompliancewithlocal,stateandfederallawsprohibitingdiscriminationinemployment.30.3NondiscriminationinServicesTheContractorwillnotdiscriminateagainstanyrecipientofanyservicesorbenefitsprovidedforinthisAgreementonthegroundsofrace,creed,color,nationalorigin,sex,sexualorientation,maritalstatus,ageorthepresenceofanysensory,mentalorphysicalhandicap.30.4lfanyassignmentand/orsubcontractinghasbeenauthorizedbytheCounty,saidassignmentorsubcontractshallincludeappropriatesafeguardsagainstdiscrimination.TheContractorshalltakesuchactionasmayberequiredtoensurefullcompliancewiththeprovisionsintheimmediatelyprecedingparagraphsherein.ProfessionalSenricesAgreement(rev.09/24/2018)Page11of19
