31.PrevailinqWaqe:Contractorshallpaytheprevailingrateofwagestoallworkers,laborers,ormechanicsemployedintheperformanceofanypartoftheWorkinaccordancewithRCW39.12andtherulesandregulationsoftheDepartmentofLaborandIndustries.ThescheduleofprevailingwagesratesforthelocalityorlocalitiesoftheWorkisdeterminedbytheIndustrialStatisticianoftheDepartmentofLaborandIndustries.ItistheContractor'sresponsibilitytoverifytheapplicableprevailingwagerate.ItisunderstoodthattheContractorisresponsibleforobtainingandcompletingallrequiredgovernmentformsandsubmittingsametotheproperauthorities.DisputesregardingprevailingwageratesshallbereferredforarbitrationtotheDirectoroftheDepartmentofLaborandIndustries.ThearbitrationdecisionshallbefinalandconclusiveandbindingonallpartiesinvolvedinthedisputeasprovidedforbyRCW39.12.060.32.DebarmentCertification:TheContractorcertifiesthatit:32.1Isnotpresentlydebarred,suspended,proposedfordebarment,declaredineligibleorvoluntarilyexcludedfromcoveredtransactionsbyanyFederaldepartmentoragency.32.2Hasnotwithinathree-yearperiodprecedingtheexecutionofthiscontractwithKittitasCounty,beenconvictedoforhadaciviljudgmentrenderedagainstthemforcommissionoffraudoracriminaloffenseinconnectionwithobtaining,attemptingtoobtain,orperformingapublicorprivateagreementortransaction,violationofFederalorStateantitruststatutesorcommissionofembezzlement,theft,forgery,bribery,falsificationordestructionofrecords,makingfalsestatements,taxevasion,receivingstolenproperty,makingfalseclaims,orobstructionofjustice.32.3Isnotpresentlyindictedfororotherwisecriminallyorcivillychargedbyagovernmentalentity(Federal,State,orlocal)withcommissionofanyoftheoffensesenumeratedinparagraph32.2ofthissection.32.4Hasnotwithinathree-yearperiodprecedingtheprecedingtheexecutionofthiscontractwithKittitasCountyhadoneormorepublictransactions(Federal,State,orlocal)terminatedforcauseofdefault.33.StandardofCareThestandardofcareapplicabletoContractor'sserviceswillbethedegreeofskillanddiligencenormallyemployedbyprofessionalengineersorconsultantsperformingthesameorsimilarservicesatthetimeContractor'sservicesareperformed.Contractorwillre-performanyservicesnotmeetingthisstandardwithoutadditionalcompensation.ProfessionalServicesAgreement(rev.09/24/2018)Page12of19
