<br />KCHD ORDINANCE 1999- 41 SOLID WASTE REGULATIONS <br />other persons and he/she has reason to believe that conditions therewith create an immediate and <br />irreparable health hazard, then he/she shall make entry. <br />4. If entry is refused, the Health Officer shall have recourse to the remedies provided by law to secure <br />entry, including but not limited to search warrants. <br />D. Violations and Penalties - Persons Not Requiring a Permit <br />1. Applicability. <br />The requirements in this section apply to all persons who are not required to obtain a permit under these <br />regulations. The violation of any provisions of these regulations shall constitute an infraction. Each <br />such violation shall constitute a separate infraction for each and every day or portion thereof during <br />which such violation is committed, continued, or not permitted. <br />2. Violations - Investigations - Evidence. <br />An authorized representative of the Health Department may investigate alleged or apparent violations of <br />these regulations. Upon request of the authorized representative of the Health Department, the person <br />allegedly or apparently in violation of these regulations shall provide information identifying <br />themselves. Willful refusal to provide information identifying a person as required by this section is a <br />misdemeanor. <br />3. Notice and Order to Correct Violation. <br />a. Issuance. Whenever an authorized representative of the Health Department determines that a <br />violation has occurred or is occurring, he/she may issue a written notice and order to correct <br />violation to the property owner or to any person causing, allowing or participating in the violation. <br />b. Content. The notice and order to correct violation shall contain: <br />(1) The name and address of the property owner or other persons to whom the notice and order to <br />correct violation is directed; <br />(2) The street address or description sufficient for identification of the building, structure, <br />premises, or land upon or within which the violation has occurred or is occurring; <br />(3) A description of the violation and a reference to that provision of the regulation which has <br />been violated; <br />(4) A statement of the action required to be taken to correct the violation and a date or time by <br />which correction is to be completed; <br />(5) A statement that a monetary penalty in an amount per day for each violation shall be assessed <br />against the person to whom the notice and order to correct violation is directed for each and <br />every day, or portion of a day, on which the violation continues following the date set for <br />correction; and <br />(6) A statement requiring the person to whom the notice and order to correct violation is directed <br />to produce receipts from a permitted solid waste disposal facility or transporter to demonstrate <br />compliance with any order issued by the Health Department.
