<br />KCHD ORDINANCE 1999- 42 SOLID WASTE REGULATIONS <br />c. Service of Order. The notice and order to correct violation shall be served upon the person to <br />whom it is directed, either personally or by mailing a copy of the order to correct violations by <br />certified mail, postage prepaid, return receipt requested, to such person at his/her last known <br />address. Proof of service shall be made at the time of service by a written declaration under penalty <br />of perjury executed by the persons effecting the service, declaring the time and date of service and <br />the manner by which service was made. <br />d. Extension. Upon written request received prior to the correction date or time, the authorized <br />representative may extend the date set for corrections for good cause. The authorized Health <br />Department representative may consider substantial completion of the necessary correction or <br />unforeseeable circumstances which render completion impossible by the date established as a good <br />cause. <br />4. Notice of Civil Infraction - Service. <br />An authorized representative of the Health Department may issue a notice of civil infraction pursuant to <br />Chapter 7.80 RCW if the authorized representative has reasonable cause to believe that the person has <br />violated any provision of these regulations or has not corrected the violation as required in the written <br />notice and order to correct violation. A notice of civil infraction may be served either by: <br />a. The authorized representative serving the notice of civil infraction on the person named in the <br />notice of civil infraction at the time of issuance; or <br />b. The authorized representative filing the notice of civil infraction with the Department court, in <br />which case the Department court shall issue the notice and the authorized representative shall have <br />it served, either personally or by mail, postage prepaid, on the person named in the notice of <br />infraction at his or her last known address. <br />5. Notice of Civil Infraction - Contents. <br />The notice of civil infraction shall include the following: <br />a. A statement that the notice represents a determination that the infraction has been committed by the <br />person named in the notice and that the determination shall be final unless contested as provided in <br />this regulation; <br />b. A statement that the infraction is a non-criminal offense for which imprisonment shall not be <br />imposed as a sanction; <br />c. A statement of the specific infraction for which the notice was issued; <br />d. A statement that monetary penalties as set forth below have been established for each infraction; <br />e. A statement of the options provided in these regulations for responding to the notice and the <br />procedures necessary to exercise these options; <br />f. A statement that at any hearing to contest the determination that the Health Department has the <br />burden of proving by a preponderance of the evidence that the infraction was committed; and that <br />the person may subpoena witnesses, including the authorized representative of the Health <br />Department, who issued and served the notice of infraction;
