<br />KCHD ORDINANCE 1999- 40 SOLID WASTE REGULATIONS <br />Owners and operators of other methods of solid waste handling shall obtain a permit from the Health <br />Officer as required in Section VI.A. by submitting an application containing information required in <br />Section VI.A.2. and such other information as may be required by the Health Officer and Ecology, <br />including but not limited to: <br />a. Preliminary engineering reports, plans, and specifications; <br />b. Operation and development plans and specifications; and <br />c. A closure plan, health and safety plan, haul route and site layout. <br />SECTION VII. ADMINISTRATION AND ENFORCEMENT <br />A. Other Laws, Regulations and Agency Requirements <br />1. All solid waste management shall be subject to the authority of other laws, regulations or other agency <br />requirements in addition to these rules and regulations. Nothing in these rules and regulations is <br />intended to abridge or alter the rights of action by the state or by persons which exist in equity, common <br />law or other statutes to abate pollution or to abate a nuisance. <br />2. Chapter 173-304 WAC and 173-351WAC, or as amended, is hereby adopted by reference. If a conflict <br />exists in the interpretation of these chapters or these regulations, the more stringent shall apply. <br />3. Information revealing the identity of persons who file complaints with the Health Department, is <br />exempt from public inspection and copying if disclosure would endanger any person's life, physical <br />safety, or property, as stipulated in RCW 42.17.310(1)(e) which is hereby adopted by this reference. If <br />at the time a complaint is filed the complainant, victim, or witness indicates a desire for disclosure or <br />nondisclosure, such desire shall govern. <br />B. Enforcement Authority <br />The Health Officer shall have the authority to enforce the provisions of these regulations equally on all <br />persons. The Health Officer is also authorized to adopt rules consistent with the provisions of these rules <br />and regulations for the purpose of enforcing and carrying out its provisions. <br />C. Right of Entry <br />1. Whenever necessary to make an inspection to enforce or determine compliance with the provisions of <br />these regulations, and other relevant laws and regulations, or whenever the Health Officer has cause to <br />believe that a violation of these regulations has been or is being committed, the Health Officer or his/her <br />duly authorized inspector may enter any building, structure, property or portion thereof at reasonable <br />times to inspect the same. <br />2. If such building, structure, property or portion thereof is occupied, the inspector shall present <br />identification credentials, state the reason for the inspection, and request entry. Entry shall not be <br />unreasonably denied by the owner or his or her agent, but may be conditioned on the owner or an agent <br />of the owner escorting the inspector, said escort to be provided immediately upon request. <br />3. If such building, structure, property or portion thereof is unoccupied, the inspector shall first make a <br />reasonable effort to locate the owner or other persons having charge or control of the building, structure, <br />property or portion thereof and request entry.
