<br />KCHD ORDINANCE 1999- 12 SOLID WASTE REGULATIONS <br />White Goods (freon containing): Refrigerators and Air Conditioning units that no longer function for which <br />they were intended that can be salvaged for scrap once proper removal of freon is removed by a qualified <br />technician. <br />Woodwaste: Solid waste consisting of wood pieces or particles generated as a by-product or waste from the <br />manufacturing of wood products, handling and storage of raw materials and trees and stumps. This includes, <br />but is not limited to, sawdust, chips, shavings, bark, pulp, hog fuel and log sort yard waste, but does not <br />include wood pieces or particles containing chemical preservatives such as creosote, pentachlorophenol or <br />copper-chrome-arsenate. <br />Yard Waste: A compostable organic material generated in yards, gardens, and private or public areas resulting <br />from the maintenance or removal of ornamental vegetation, including, but not limited to, brush, branches, <br />prunings, grass, leaves, flowers, shrubs, and small trees. Yard waste shall not include land clearing wastes, <br />construction and demolition wastes, woodwaste, animal excrement, rocks, garbage, moderate risk waste, or <br />dangerous waste. <br /> <br />SECTION IV. ON-SITE SOLID WASTE MANAGEMENT STANDARDS <br />A. General Standards <br />1. Owner Responsibilities for Solid Waste. <br />The owner, operator or occupant of any premise, business establishment or industry shall be responsible <br />for the satisfactory and legal handling and/or disposal of all solid waste generated by them or <br />accumulated on the property. Except as provided in Section IV.B.6., single-family residences and <br />single-family farms are prohibited from dumping or depositing solid waste onto or under the surface of <br />land owned or leased by them. All solid wastes must be stored in accordance with Section IV.A.2. until <br />removed to a permitted solid waste handling facility. <br />2. Storage Requirements. <br />a. Responsibility. The owner and/or occupant of any premises shall be responsible for the safe and <br />sanitary storage of all solid wastes generated or accumulated at that premises until it is removed to a <br />permitted solid waste facility. The storage area and storage containers shall be maintained in a <br />clean, safe, and nuisance-free condition. Provisions shall be made for the safe and sanitary disposal <br />of leakage and drainage from sanitary compactors, drop boxes, and storage areas. Materials shall be <br />contained to prevent blowing. Additionally, generators should refer to Section IV.B. pertaining to <br />specific solid waste handling requirements. <br />b. On-Site Storage. <br />(1) The owner, operator or occupant of any premises, business establishment or industry shall <br />store all garbage and rubbish in containers that meet the following requirements, except for <br />recyclables which are addressed in Section IV.A.2.b.(3).: <br />(A) Disposable containers shall be sufficiently strong to allow lifting without breakage.
