StateofWashingtonDepartmentofEcologyPage18of22AgreementNo:SWMCLCP-2123-KiCoSW-00045ProjectTitle:KiCoSW-00045LitterandIllegalDumpCleanupandPreventionProjectRecipientName:KITTITASCOUNTYSOLIDWASTE16.KICKBACKSRECIPIENTisprohibitedfrominducingbyanymeansanypersonemployedorotherwiseinvolvedinthisAgreementtogiveupanypartofthecompensationtowhichhe/sheisotherwiseentitledtoorreceiveanyfee,commission,orgiftinreturnforawardofasubcontracthereunder.17.MINORITYANDWOMEN'SBUSINESSENTERPRISES(MWBE)RECIPIENTisencouragedtosolicitandrecruit,totheextentpossible,certifiedminority-owned(MBE)andwomen-owned(WBE)businessesinpurchasesandcontractsinitiatedunderthisAgreement.ContractawardsorrejectionscannotbemadebasedonMWBEparticipation;however,theRECIPIENTisencouragedtotakethefollowingactions,whenpossible,inanyprocurementunderthisAgreement:a)Includequalifiedminorityandwomen'sbusinessesonsolicitationlistswhenevertheyarepotentialsourcesofgoodsorservices.b)Dividethetotalrequirements,wheneconomicallyfeasible,intosmallertasksorquantities,topermitmaximumparticipationbyqualifiedminorityandwomen'sbusinesses.c)Establishdeliveryschedules,whereworkrequirementspermit,whichwillencourageparticipationofqualifiedminorityandwomen'sbusinesses.d)UsetheservicesandassistanceoftheWashingtonStateOfficeofMinorityandWomen'sBusinessEnterprises(OMWBE)(866-208-1064)andtheOfficeofMinorityBusinessEnterprisesoftheU.S.DepartmentofCommerce,asappropriate.18.ORDEROFPRECEDENCEIntheeventofinconsistencyinthisAgreement,unlessotherwiseprovidedherein,theinconsistencyshallberesolvedbygivingprecedenceinthefollowingorder:(a)applicablefederalandstatestatutesandregulations;(b)TheAgreement;(c)ScopeofWork;(d)SpecialTermsandConditions;(e)Anyprovisionsortermsincorporatedhereinbyreference,includingthe"AdministrativeRequirementsforRecipientsofEcologyGrantsandLoans";(f)EcologyFundingProgramGuidelines;and(g)GeneralTermsandConditions.19.PRESENTATIONANDPROMOTIONALMATERIALSECOLOGYreservestherighttoapproveRECIPIENT'scommunicationdocumentsandmaterialsrelatedtothefulfillmentofthisAgreement:a)Ifrequested,RECIPIENTshallprovideadraftcopytoECOLOGYforreviewandapprovalten(10)businessdayspriortoproductionanddistribution.b)RECIPIENTshallincludetimeforECOLOGY'sreviewandapprovalprocessintheirprojecttimeline.c)Ifrequested,RECIPIENTshallprovideECOLOGYtwo(2)finalcopiesandanelectroniccopyofanytangibleproductsdeveloped.Copiesincludeanyprintedmaterials,andalltangibleproductsdevelopedsuchasbrochures,manuals,pamphlets,videos,audiotapes,CDs,curriculum,posters,mediaannouncements,orgadgetswithamessage,suchasarefrigeratormagnet,andanyonlinecommunications,suchaswebpages,blogs,andtwittercampaigns.Ifitisnotpracticaltoprovideacopy,thentheRECIPIENTshallprovideadescription(photographs,drawings,printouts,etc.)thatbestrepresentstheitem.AnycommunicationsintendedforpublicdistributionthatusesECOLOGY'slogoshallcomplywithECOLOGY'sgraphicrequirementsandanyadditionalrequirementsspecifiedinthisAgreement.BeforetheuseofECOLOGY'slogocontactECOLOGYforguidelines.RECIPIENTshallacknowledgeinthecommunicationsthatfundingwasprovidedbyECOLOGY.20.PROGRESSREPORTINGTemplateVersion12/10/2020
