GM 752 Amendment No. 1 <br />WASHINGTON STATE DEPARTMENT OF TRANSPORTATION <br />AND KITTITAS COUNTY <br />Interstate 90 and Sparks Road <br />This Amendment No. 1 to Agreement GM 752 is made and entered into between the <br />Washington State Department of Transportation, hereinafter the "STATE," and Kittitas <br />County, hereinafter the "COUNTY'; together the "Parties". <br />WHEREAS, the Parties entered into Agreement GM 752 on May 23, 1973, which contained <br />certain terms and conditions related to the construction of Interstate 90 and to certain <br />intersecting County roads and frontage roads; and <br />WHEREAS, the Agreement obligated the State to convey certain lands in fee simple <br />interest to the County, one segment of which was that portion of what is now known as <br />West Sparks Road in the vicinity of and passing under Interstate 90. This was done by <br />Quit Claim Deed recorded under Auditor's File No. 430495; and <br />WHEREAS, the Agreement obligated the State to convey an easement to the County for <br />the portion of what is now known as West Sparks Road that passes under the westbound <br />lanes of Interstate 90. This conveyance never took place; and <br />WHEREAS, the State now requires ownership of a portion of West Sparks Road that was <br />conveyed to the County by the Quit Claim Deed cited above for its current project involving <br />the realignment of the westbound lanes of Interstate 90; and <br />WHEREAS, the State will eventually abandon or surplus the existing westbound lanes of <br />Interstate 90 after construction of the new westbound lanes is complete, and <br />WHEREAS, the State must convey an easement to the County prior to the abandonment of <br />the former westbound lanes of Interstate 90 so that West Sparks Road can remain intact, <br />and <br />1 <br />
