DepartmentofJusticeOfficeofJusticeProgramsAWARDCONTINUATIONOfficeofJuvenileJusticeandSHEETPAGE3OF9DelinquencyPreventionCooperativeAgreementPROJECTNUMBER2015-MC-FX-KO39AWARDDATE09/21/2015SPECIALCONDITIONS7.Restrictionsandcertificationsregardingnon-disclosureagreementsandrelatedmattersNorecipientorsubrecipientunderthisaward,orentitythatreceivesacontractorsubcontractwithanyfundsunderthisaward,mayrequireanyemployeeorcontractortosignaninternalconfidentialityagreementorstatementthatprohibitsorotherwiserestricts,orpurportstoprohibitorrestrict,thereporting(inaccordancewithlaw)ofwaste,fraud,orabusetoaninvestigativeorlawenforcementrepresentativeofafederaldepartmentoragencyauthorizedtoreceivesuchinformation.Theforegoingisnotintended,andshallnotbeunderstoodbytheagencymakingthisaward,tocontravenerequirementsapplicabletoStandardForm312(whichrelatestoclassifiedinformation),Form4414(whichrelatestosensitivecompartmentedinformation),oranyotherformissuedbyafederaldepartmentoragencygoverningthenondisclosureofclassifiedinformation.1.Inacceptingthisaward,therecipient-a.representsthatitneitherrequiresnorhasrequiredinternalconfidentialityagreementsorstatementsfromemployeesorcontractorsthatcurrentlyprohibitorotherwisecurrentlyrestrict(orpurporttoprohibitorrestrict)employeesorcontractorsfromreportingwaste,fraud,orabuseasdescribedabove;andb.certifiesthat,ifitleamsorisnotifiedthatitisorhasbeenrequiringitsemployeesorcontractorstoexecuteagreementsorstatementsthatprohibitorotherwiserestrict(orpurporttoprohibitorrestrict),reportingofwaste,fraud,orabuseasdescribedabove,itwillimmediatelystopanyfurtherobligationsofawardfunds,willprovidepromptwrittennotificationtotheagencymakingthisaward,andwillresume(orpermitresumptionof)suchobligationsonlyifexpresslyauthorizedtodosobythatagency.2.Iftherecipientdoesorisauthorizedtomakesubawardsorcontractsunderthisaward-a.itrepresentsthat-(1)ithasdeterminedthatnootherentitythattherecipient'sapplicationproposesmayorwillreceiveawardfunds(whetherthroughasubaward,contract,orsubcontract)eitherrequiresorhasrequiredinternalconfidentialityagreementsorstatementsfromemployeesorcontractorsthatcurrentlyprohibitorotherwisecurrentlyrestrict(orpurporttoprohibitorrestrict)employeesorcontractorsfromreportingwaste,fraud,orabuseasdescribedabove;and(2)ithasmadeappropriateinquiry,orotherwisehasanadequatefactualbasis,tosupportthisrepresentation;andb.itcertifiesthat,ifitlearnsorisnotifiedthatanysubrecipient,contractor,orsubcontractorentitythatreceivesfundsunderthisawardisorhasbeenrequiringitsemployeesorcontractorstoexecuteagreementsorstatementsthatprohibitorotherwiserestrict(orpurporttoprohibitorrestrict),reportingofwaste,fraud,orabuseasdescribedabove,itwillimmediatelystopanyfurtherobligationsofawardfundstoorbythatentity,willprovidepromptwrittennotificationtotheagencymakingthisaward,andwillresume(orpermitresumptionof)suchobligationsonlyifexpresslyauthorizedtodosobythatagency.8.Recipientunderstandsandagreesthatitcannotuseanyfederalfunds,eitherdirectlyorindirectly,insupportofanycontractorsubawardtoeithertheAssociationofCommunityOrganizationsforReformNow(ACORN)oritssubsidiaries,withouttheexpresspriorwrittenapprovalofOJP.9.Therecipientagreestocomplywithanyadditionalrequirementsthatmaybeimposedduringthegrantperformanceperiodiftheagencydeterminesthattherecipientisahigh-riskgrantee.OJPFORM4000/2(REV.4-88)
