DepartmentofJusticeOfficeofJusticeProgramsAWARDCONTINUATIONOfficeofJuvenileJusticeandSHEETPAGE4OF9DelinquencyPreventionCooperativeAgreementPROJECTNUMBER2015-MC-FX-KO39AWARDDATE09/21/2015SPECL4LCONDITIONS10.TherecipientagreestocomplywithapplicablerequirementsregardingregistrationwiththeSystemforAwardManagement(SAM)(orwithasuccessorgovernment-widesystemofficiallydesignatedbyOMBandOJP).Therecipientalsoagreestocomplywithapplicablerestrictionsonsubawardstofirst-tiersubrecipientsthatdonotacquireandprovideaDataUniversalNumberingSystem(DUNS)number.ThedetailsofrecipientobligationsarepostedontheOfficeofJusticeProgramswebsiteathttp://www.ojp.gov/funding/sam.htm(Awardcondition:RegistrationwiththeSystemforAwardManagementandUniversalIdentifierRequirements),andareincorporatedbyreferencehere.Thisspecialconditiondoesnotapplytoanawardtoanindividualwhoreceivedtheawardasanaturalperson(i.e.,unrelatedtoanybusinessornon-profitorganizationthatheorshemayownoroperateinhisorhername).11.PursuanttoExecutiveOrder13513,"FederalLeadershiponReducingTextMessagingWhileDriving,"74Fed.Reg.51225(October1,2009),theDepartmentencouragesrecipientsandsubrecipientstoadoptandenforcepoliciesbanningemployeesfromtextmessagingwhiledrivinganyvehicleduringthecourseofperformingworkfundedbythisgrant,andtoestablishworkplacesafetypoliciesandconducteducation,awareness,andotheroutreachtodecreasecrashescausedbydistracteddrivers.12.Therecipientagreestocomplywithallapplicablelaws,regulations,policies,andguidance(includingspecificcostlimits,priorapprovalandrepottingrequirements,whereapplicable)governingtheuseoffederalfundsforexpensesrelatedtoconferences,meetings,trainings,andotherevents,includingtheprovisionoffoodand/orbeveragesatsuchevents,andcostsofattendanceatsuchevents.InformationonrulesapplicabletothisawardappearsintheDOJGrantsFinancialGuide(currently,assection3.10of"PostawardRequirements"inthe"2015DOJGrantsFinancialGuide").13.TherecipientunderstandsandagreesthatanytrainingortrainingmaterialsdevelopedordeliveredwithfundingprovidedunderthisawardmustadheretotheOJPTrainingGuidingPrinciplesforGranteesandSubgrantees,availableathttp://www.ojp.usdoj.gov/funding/ojptrainingguidingprinciples.htm.14.TherecipientagreesthatifitcurrentlyhasanopenawardoffederalfundsorifitreceivesanawardoffederalfundsotherthanthisOJPaward,andthoseawardfundshavebeen,arebeing,oraretobeused,inwholeorinpart,foroneormoreoftheidenticalcostitemsforwhichfundsarebeingprovidedunderthisOJPaward,therecipientwillpromptlynotify,inwriting,thegrantmanagerforthisOJPaward,and,ifsorequestedbyOJP,seekabudget-modificationorchange-of-project-scopegrantadjustmentnotice(GAN)toeliminateanyinappropriateduplicationoffunding,15.Therecipientunderstandsandagreesthatawardfundsmaynotbeusedtodiscriminateagainstordenigratethereligiousormoralbeliefsofstudentswhoparticipateinprogramsforwhichfinancialassistanceisprovidedfromthosefunds,oroftheparentsorlegalguardiansofsuchstudents.16.Therecipientunderstandsandagreesthat-(a)Noawardfundsmaybeusedtomaintainorestablishacomputernetworkunlesssuchnetworkblockstheviewing,downloading,andexchangingofpornography,and(b)Nothinginsubsection(a)limitstheuseoffundsnecessaryforanyFederal,State,tribal,orlocallawenforcementagencyoranyotherentitycarryingoutcriminalinvestigations,prosecution,oradjudicationactivities.17.ArecipientthatiseligibleunderthePart200UniformRequirementstousethe"deminimis"indirectcostratedescribedin2C.F.R.200.414(f),andthatelectstousethe"deminimis"indirectcostrate,mustadviseOJPinwritingofbothitseligibilityanditselection,andmustcomplywithallassociatedrequirementsinthePart200UniformRequirements.The"deminimis"ratemaybeappliedonlytomodifiedtotaldirectcosts(MTDC).18.Therecipientmustcollect,maintain,andprovidetoOJP,datathatmeasuretheperformanceandeffectivenessofactivitiesunderthisaward,inthemanner,andwithinthetimeframes,specifiedintheprogramsolicitation,orasotherwisespecifiedbyOJP.DatacollectionsupportscompliancewiththeGovernmentPerformanceandResultsAct(GPRA)andtheGPRAModernizationAct,andotherapplicablelaws.OJPFORM4000/2(REV.4-88)
