For the <br />purpose of this scopes it is assumed that a No -Effect Letter will meet the needs and <br />requirements of the reviewing agency. This scope assumes that formal consultation with <br />the USFWS and NOAA Fisheries, under Section 7(a)(2) of the ESA, will not be <br />necessary. <br />ESA assumes that the project can be designed and constructed to result in a combined <br />"no -effect" determination for all listed species. The project is expected to include a small <br />amount of new impervious surface. In order to demonstrate the project will have "no <br />effect" on listed fish species, ESA will conduct a stormwater analysis using the WSDOT <br />Hi -Run Stormwater Loading and Dilution Model. <br />Assumptions <br />Because the proposed project would not affect salmon bearing waters and can <br />be scheduled to avoid temporary impacts that could adversely affect listed <br />species, it is assumed that ESA compliance will be documented through a "no - <br />effect" letter with appropriate analysis to reach this conclusion. This assumes that <br />both project construction and operation, as well as any mitigation actions, will not <br />result in either direct or indirect effects to listed species. If, based on detailed <br />design information, a no -effect determination cannot be reached and a BA is <br />required for ESA compliance, this scope of work will need to be amended to <br />reflect the greater level of effort for preparing a full BA. <br />The County and WSDOT will each provide one consolidated set of comments for <br />each review draft. <br />Deliverables <br />• One (1) Draft BA for County review in electronic format. <br />• One (1) Draft BA for WSDOT review and comment in electronic format. <br />• One (1) Final BA in electronic format for submission to WSDOT. <br />Task 2.90—Shoreline Environment Review Memorandum <br />The project will be required to comply with the Kittitas County Shoreline Master Program <br />(SMP) for work within 200 feet of waters of the State. The Yakima River shoreline is <br />designated as Rural Conservancy within the project area. However, maintenance <br />activities of existing structures is not considered "development" within the County's SMP <br />(KCMG 17B.01.070(2)). ESA will prepare a memorandum to document the project's <br />compliance with all regulatory requirements for protection of the shoreline environment, <br />including design elements and construction BMPs. <br />Assumptions <br />• It is assumed the project will not require a Shoreline Substantial Development <br />Permit or a Conditional Use Permit. If it is determined a different level of <br />documentation is required for compliance with the County's SMP, a scope and <br />budget amendment by be needed. <br />Deliverables <br />
