Assumptions <br />• If the County chooses to prepare a separate SEPA Checklist, rather than <br />adopting the NEPA document, this scope and budget will require an amendment. <br />Deliverables <br />One (1) Draft Notice of Determination and Adoption for County review in <br />electronic format. <br />One (1) Final Notice of Determination and Adoption in electronic format. <br />Task 2.70 — Hydraulic Project Approval <br />The project will be required to comply with the State Hydraulic Code due to work over <br />waters of the State. Application materials will be prepared to support Washington <br />Department of Fish and Wildlife (WDFW) issuance of a Hydraulic Project Approval <br />(HPA). Materials will likely include, but are not limited to, the technical studies described <br />in this scope of work, construction methods and BMPs, and a site plan. The permit <br />materials will be submitted to WDFW via the online Aquatic Protection Permitting <br />System. <br />Assumptions <br />• The project will not require wetland fill, or in -water work and the area is not <br />defined as navigable, so we assume the project will not require permits from the <br />U.S. Army Corps of Engineers. <br />• The County will be the owner and signature authority on all permits. The County <br />will be responsible for any fees associated with publishing and distributing <br />notices or processing permit applications. <br />• The HPA application will be based on 60 percent or greater engineering plans. <br />• A mitigation plan needed to meet County regulations will be submitted with the <br />JARPA submittal; mitigation measures composed on standard best management <br />practices, will be identified in the critical areas report which will accompany the <br />HPA application. If a more detailed mitigation plan is required to offset project <br />impacts however, a scope addendum will be required to develop a draft and final <br />mitigation plan. <br />• The County and WSDOT will each provide one consolidated set of comments for <br />each review draft. <br />Deliverables <br />One (1) Draft HPA application for County review in electronic format. <br />One (1) Draft HPA application for WSDOT review and comment in electronic <br />format. <br />• One (1) Final HPA application in electronic format for submission to WDFW. <br />Task 2.80 — Biological Assessment, No -Effect tetter <br />ESA will prepare a Biological Assessment (BA) to assist with consultation efforts under <br />Section 7 of the Endangered Species Act (ESA) required by WSDOT, National Marine <br />Fisheries Service (NMFS) and U.S. Fish and Wildlife Service (USFWS). The BA will <br />conform to standards in the U.S. Fish and Wildlife Service (USFWS) Biological <br />Assessment Preparation and Review (1999) standards, the National Marine Fisheries <br />
