Water Right Permitting Services, Mt. Adams Orchard Company; Kiickitat County, WA. LAI assisted the <br />Mt. Adams Orchard Company (MAOC) with an annual consumptive quantity (ACQ) analysis and a <br />determination of the extent of spreading available to <br />MAOC due to ongoing water conservation measures being <br />implemented bythe orchard company. The ACQ analysis <br />was prepared to assist MAOC with change applications to <br />increase the total irrigated area from 761 to 961 acres. <br />Conserved water is being generated through <br />implementation of scientific irrigation scheduling and low - <br />flow emitter sprinklers. The ACQ methodology used by LAI <br />was consistent with the technical approach documented <br />in a Voluntary Regional Agreement between the Columbia <br />and Snake River irrigators Association and Ecology under <br />Revised Code of Washington 90.90.030, for the purpose of <br />providing new waterfoI out -of -stream use, streamlining <br />the application process, and protecting instream flow in <br />the mainstem Columbia and lower Snake rivers. LAI staff re <br />Katherine Ryf and Eric Weber. <br />Boistfort Valley Water Corporation; Lewis County, WA. In 2018 and 2019, LAI assisted Boistfort Valley <br />Water Corporation (BVWC) with portfolio review and a surface water right transaction. The transferred <br />right was identified after a sub -basin scale review of eligible water rights. The transaction involved <br />z r ; 4 change of the purpose of use, place of use, and point <br />of diversion. BVWC is located in WRIA 23 in the upper <br />ti .*" ,ter:' Chehalis River Valley. The water company has about <br />'' , v .!,'! �� •� 800 rural connections in a 25 -square -mile area. <br />,ZA Minimum instream flows on the Chehalis River are <br />vw.�mo T;�r�i,�� • moi:', <br />defined in Chapter 173-522 of the Washington <br />experiences <br />•� Administrative Code. The Chehalis River ex » p <br />nn flows below the minimum in some years, leading to <br />curtailment of interruptible water right holders by <br />Ecology. Most recently, water use was curtailed by <br />Ecology during the summer of 201911n accordance <br />with the rule. BVWC was pursuing older surface water <br />rights in an effort to reduce its exposure to <br />n, interruption based on low -flow conditions and to <br />comply with Washington State Department of Health requirements. The transaction Involved a multi - <br />parcel property along the mainstem Chehalis River that was permitted prior to the instream flow rule. <br />EAI assisted BVWC with due diligence review, negotiation of transaction details including meeting with <br />the farmer and farmer's counsel, as well as assisting with preparation of the purchase and sale <br />agreement and water right change application. Due diligence tasks included interviewing (through <br />submitted questions) the farmer about current and historical use and assisting with affidavit <br />preparation. LAI performed an extent and validity analysis on the water rights, prepared the change <br />applications, and presented the applications at the Lewis County Water Conservancy Board (LCWCB). <br />After the application was accepted by the LCWCB, LAI attended the field investigation with LCWCB <br />members and prepared the draft ROE for LCWCB review. The LCWCB approved the ROE with a signed <br />Kittitas County 11 Water Banking Program Support <br />
